Fatal Latah County Car Crash on Highway 95: Key Details and Legal Insights

In Latah County, Idaho, on the morning of November 25th, a tragic two-vehicle crash unfolded at approximately 10:38 a.m. The incident took place on Highway 95, specifically at the intersection with Eid Road, drawing the attention of local authorities and emergency services. Two men, both residents of Lewiston, Idaho, found themselves involved in this unfortunate accident.

The first driver, a 40-year-old man operating a 2001 Ford Focus, was navigating northbound on Highway 95 when he encountered significant traffic delays due to on-going road construction. Meanwhile, the second driver, a 65-year-old man behind the wheel of a 2021 Chevrolet Silverado, was also traveling north and closely following the stalled traffic when the Ford, in a desperate attempt to avoid the congestion, swerved abruptly and collided with his vehicle. The impact caused the Ford to veer off the roadway, ultimately driving down an embankment and leaving the driver in grave condition.

The driver of the Ford sustained major injuries in the crash, necessitating immediate transportation to a local hospital. Sadly, despite medical intervention, he succumbed to his injuries shortly after arrival. Authorities noted that he was not wearing a seat belt at the time of the accident, raising concerns about safety compliance during vehicular travel. In contrast, the driver of the Chevrolet was wearing a seat belt and emerged from the incident without major injuries.

We extend our deepest condolences to the family and friends of the man who lost his life in this devastating accident. The community grieves the loss of such a life too soon.

According to a recent report from the Idaho Department of Transportation, a staggering total of 27,679 motor vehicle crashes occurred across the state in 2023. The Idaho Traffic Crash Clock highlights a sobering statistic: a traffic crash took place every 19 minutes, underscoring the urgent need for enhanced road safety awareness and practices.

LIABILTIY FOR ACCIDENTS IN IDAHO

No one who takes to the roads wants to be embroiled in an automobile accident, yet the harsh reality is that they occur. Idaho operates under a fault-based system that assigns liability to the party deemed most at fault in such incidents. A critical legal concept known as “comparative negligence” plays a pivotal role in determining the degree of negligence attributable to each involved party. Notably, if the Plaintiff’s negligence is assessed to be less than 50%, they generally retain the right to pursue damages from the Defendant, or their respective insurance policy.

Our dedicated personal injury attorneys stand ready to provide guidance to injured parties, helping them navigate their unique situations and understand how Idaho’s legal principles of negligence, causation, and liability pertain to their cases.
