33 days have passed since the Carabineros non-commissioned officer, Rita Olivares Raio, died after being shot in the head in the middle of a police procedure that he attended in the Quilpué commune, Valparaíso region. She was 43 years old at the time of her cowardly crime and became the martyr 1232 of the police institution.
After more than a month, his case today adds a new precedent. The family of the deceased official decided to file a complaint for the crime of homicide of the Carabinero in the exercise of his functions against the subjects accused by the Public ministry as responsible for his death.
We talk about Luis Martinez-Conde Riesco, Edward Fuenzalida Leiva, Miguel Acevedo Tauda, Matias Peralta Parra, Maximiliano Fuenzalida Leiva y Elizabeth Soto Soto. All of them to date have been formalized by the prosecuting agency for their eventual participation in crimes ranging from robbery to homicide.
The legal action goes in two directions: seek the maximum criminal responsibilities of those formalized and determine if there is responsibility of the police institution for lack of service. That is to say, from the State, to eventually pursue civil responsibilities for the damage caused to the environment of the then second sergeant.
There are a series of proceedings that the complainants requested from the Public Ministry, they point out from the family environment. One of them, for example, aims to notify the uniformed police of the reports and audios from CENCO of the complaint received on the day of the events and of the orders or internal communications of the institution.
Another of them, in the same line, seeks to know the delivery of security elements to Rita Olivaresin order to find out if the senior petty officer had the necessary safeguards for the type of procedure that she had to face on the day of her death.
Claudio Gonzalez Salgado, the plaintiff lawyer, explains that these proceedings seek to “establish whether or not the Carabineros complied with their duty to effectively protect the life of the official.” The professional, from the legal firm González & Compañía Abogados, adds that the institution “is obliged to give the conditions and adequate instructions for their safety and the delivery of the defense and security equipment necessary for the fulfillment of their functions.”
