The appeal against the decision of the Joint Jury Court by which the two defendants were acquitted for the murder of Giorgos Karaivaz the mother and sister of the deceased journalist, Panagiotas and Anatolia Karaivaz, request with their application to the Athens Appeals Prosecutor. In particular, the mother and sister of Giorgos Karaivaz through their lawyers Spyros Charitatou and Rois Pavleas as well as Mrs. Alexandropoulou – Karaivaz through Mr. Xylourgidis are requesting an appeal against the acquittal decision of the first instance, stating that the court that tried the two brothers for the murder of the journalist, did not properly assess the evidence and testimony and misinterpreted the law.
Citing a series of elements for the trial of the case and secondly the members of the family of G. Karaivaz in the relevant application that they submitted yesterday Thursday to the Prosecutor’s Office of Athens, state among other things the following: “The case must be re-tried and be investigated in depth by the Mixed Jury Court of Appeal of Athens, before which the appeal against the defendants will be heard and the appropriate punishment imposed on them for the acts of manslaughter with intent to commit suicide as well as illegal carrying of weapons. Giorgos Karaivaz was murdered because he was steadfastly non-integrated and non-negotiable. He was murdered because he was a Journalist to the core. As he prophetically wrote: “You may level me psychologically, professionally, even biologically, but I will not allow you to melt my voice.”
The request of the members of the Karaivaz family to file an appeal against the first-instance acquittal decision will be examined by the Athens Appeals Prosecutor’s Office as the only competent one to rule on whether the two brothers who had been tried for the case will sit again on the “stool” of the Court of Appeal in order to to be tried for the journalist’s murder.
