The employee is reinstated and compensated even if he uses false medical certificates for his son’s illness. The signature of the health worker on the document does not appear to be genuine, but the worker does not contribute to the forgery nor is he responsible for the “happy” management of the professional office: in the absence of the doctor, the certificates are sometimes signed by a colleague or even by the secretary; therefore, the subjective element of the disciplinary offense is missing: it is not proven that the worker is aware that the document is false and the interested party uses it to gain the undue advantage of the days of leave. Thus the Civil Court of Cassation, labor section, in order no. 20891 of 07/26/2024.
