Failure to provide emergency assistance: Schweizer (21) hears torture during live game party and is convicted
A man was tortured and threatened with death during an Xbox Live party in Germany. A Rheintaler (21) listened, but did not report it to the police. He was therefore sentenced by penal order.

A person from the Rhine Valley was recently convicted of failing to provide emergency aid. So far, so unspectacular. The distance to the scene of the crime and the execution of the offense are exceptional. In need was a father near Nuremberg at the end of 2019. He was threatened with death by gamer colleagues of his then 14-year-old son.
The then 23 and 21-year-old buddies from the Cologne (D) area had heard from the 14-year-old that his father had beaten him. They wanted revenge on him and planned to ambush him in a closet in the apartment and give the father a beating if he hits him once more. The beating should also include torture and, if necessary, killing, as the Nuremberg-Fürth public prosecutor said on request. The situation escalated even before the young men might carry out the plan: The 14-year-old threatened his father with a knife and was then placed in a youth facility.
Tied up with cable ties
The young people from the Cologne area nevertheless implemented their plan hours later – following all, they were already on their way to Bavaria. They pretended to be police officers and got into the apartment and tied up the father and sister with cable ties. The father was then hit in the head with a hammer handle, his air supply was cut off until he might hardly breathe and a mock execution was staged three times with a blank gun, like the portal Nordbayern.de writes. Meanwhile, the sister, who was also tied up, thought that something bad would happen to her soon.
The whole scene was acoustically transmitted live in an Xbox live chat. The son probably also overheard the sentenced Rheintaler and at least two other people. According to the public prosecutor’s office, it is unclear how many listened in total.
Car stolen and wrecked
The noise in the apartment startled neighbors who called the police. The two perpetrators then stole the father’s car and made off. However, they didn’t get far. While fleeing from the police, the 23-year-old lost control of the Ford Focus, which took off, broke through a wall and landed in a beverage store (see photo gallery above).
1200 francs for fines and fees
The Rheintaler, who followed the crime via chat, was sentenced by the St. Gallen public prosecutor’s office in mid-August for failing to provide emergency aid. He failed to “help the man, who was in immediate danger of death, although he was acoustically connected to the perpetrators via Xbox Live party before, but especially during the crime,” says the penalty order. Under the circumstances, he might have been expected to help or inform the police. Since the 21-year-old failed to do so, he was sentenced to a conditional fine of 100 daily rates of CHF 30 and a fine. In total, he has to pay CHF 1,200 with fees and expenses. The punishment also includes the fact that the Rheintaler had forwarded a video via Whatsapp in which hard pornography can be seen. In addition, the confiscated X-Box consoles will be destroyed.
The main perpetrator was sentenced to six years and six months in prison in Germany. His accomplice received a suspended sentence because he has autism. The son also received a conditional youth sentence. The tortured father suffered a cerebral hemorrhage and was then in the hospital for weeks, while the sister suffered from fear of death during the crime. Father and daughter have moved. In fact, they mightn’t stand it any longer.
omission of emergency aid
Florian Schneider, deputy head of communications at the St. Gallen cantonal police, explains the omission of emergency aid in general (not the specific case above): “It varies from case to case and is sometimes a bit complicated. But basically it’s regarding moral courage in the broadest sense,” says Schneider. “It’s possible that you have no idea what to do in a situation, but the minimum is to pick up the phone and call 117,” says Schneider. It is important that the police can start to do something and help as best they can. “No one asks people to put their lives in danger. But then, when they are safe, they should inform the police or another emergency number, »says Schneider. There are cases where it is clear that someone will not provide emergency aid. In other cases, however, one cannot draw clear limits as to when someone commits the omission of emergency aid. (AMJ)
