Exception to the “Austerity Ordinance” that gives ministries and public institutions free rein to buy hundreds of cars

On Friday, the government introduced in the emergency ordinance aimed at reducing the waste of budget expenditures a provision that will allow ministries and public institutions to continue the auctions already started, but also the direct purchases of cars: all purchases made through the Rabla program will continue. Dozens of new such direct purchases have been made today by Environmental Protection Agencies.

The final form of the Emergency Ordinance adopted by the Government on Friday introduced an essential exception to the measure prohibiting institutions and public authorities from purchasing, leasing or renting cars.

All purchases through the Rabla Program carry over

More specifically, the Government introduced a new paragraph in the Emergency Ordinance whereby all purchases made through the Rabla program can be carried forward.

Thus, the following will also be exempted from the GEO:

  • d) cars whose purchase is made within the Program regarding the reduction of greenhouse gas emissions in transport by promoting non-polluting road transport vehicles from an energy point of view, financed from the Environmental Fund as well as within the Program to stimulate the renewal of the Park national car 2020-2024, according to the Government Emergency Ordinance no. 196/2005 regarding the Environmental Fund, approved with amendments and additions by Law no. 105/2006, with subsequent amendments and additions.

Basically, it is regarding purchases through the “Rabla Program”.

This exception was not provided for in the GEO project still under public debate, in which only the purchases made within the projects financed from external non-reimbursable funds and through the PNRR, as well as ongoing public purchases, were exempted.

Why does the measure announced by Căciu regarding the termination of car purchases become useless in the ongoing procedures

The introduction of this exception that allows ministries and public institutions to continue their purchases of cars through the Rabla Program renders useless another measure announced on Friday by the PSD Minister of Finance, Adrian Câciu.

He said that all procedures for the purchase of cars in which the winners of the procedures have not been announced will cease, less so in purchases with EU funding, PNRR or projects that are the subject of the loan agreement with the World Bank.

This is how the nodification sounds in the GEO adopted today by the Government:

  • “(5) Starting with the entry into force of this emergency ordinance, all public procurement procedures for the goods provided for in paragraph (1) lit. a) (for car purchases) for which the stage of communication of the result of the public procurement procedure has not been completed.”

Such a measure would have had an effect if the exception regarding purchases through the Rabla Program had not been introduced.

  • Why? Because almost all of the recent wave of direct purchases and newly launched tenders for the purchase of hundreds of cars are mostly done through the Rabla Program under the National Car Park Renewal Incentive Program 2020-2024.

For example, just today, when the Government adopted this Emergency Ordinance, several Environmental Protection Agencies in the country made a wave of direct purchases of cars. Surprise? All are through the Rabla program!

HotNews.ro contact, Laurentiu Paștinaru, president of the National Agency for Environmental Protection (ANPM) stated that “all these purchases are through the Rabla Clasic and Rabla Plus programs”.

Furthermore, many of the tenders just launched by various Ministries are also done through the Rabla Program. Examples: The auction of 66 cars from the Ministry of Defenceor that of 18 cars from the Environmental Fund Administration.

Even if they have not announced their winners, these auctions will not be interrupted thanks to the exception introduced today by the Government.
