A political agreement was reached between the European Parliament and the Council on the investigation of accidents in the maritime transport sector.
The co-drfollowings agreed to revise the 2009 Major Casualty Directive, with the aim of simplifying and clarifying the current regime governing investigations and extending the scope, not only to maritime transport vessels to which international conventions apply, but also on the smallest fishing vessels under 15 meters.
As requested by the MEPs, the deadlines for the investigations will be faster. Investigations must begin within 2 months and be completed within 12 months of the date of the accident or incident.
Update of European Law
A period of 2 months is provided for the preliminary assessment of a very serious marine accident involving a fishing vessel of less than 15 meters in length.
In addition, the European Maritime Safety Agency (EMSA) will provide operational support and training to national investigative authorities at their request, while respecting their operational independence.
The revised directive also aligns its law EU with the most up-to-date international provisions adopted by the International Maritime Organization and requires Member States’ accident investigation authorities to engage in a peer review process to improve, learn from each other and improve their processes and outcomes.
2,000 accidents every year in EU waters
“Although maritime safety in EU waters is very high, with few deaths and no recent major oil spills, more than 2,000 maritime accidents and incidents are still reported every year,” the European Commission points out.
According to iefimerida, Transport Commissioner Adina Valean said: “Today’s agreement will help operators and regulators take appropriate measures to reduce accidents, ultimately preventing loss of life and pollution of the environment.”
The political agreement reached today must now be formally approved by the European Parliament and the Council and the new rules will come into force 20 days later. Member States will have 30 months following the entry into force of the revised directive to transpose its provisions into national law.
