Epic Games earlier introduced a commission in the game “Fortnite” launched in the App Store that can bypass the App Store’s 30% commission for in-app purchases. “Fortnite” was immediately removed from the App Store for violating the in-app purchase policy. Epic Games then filed an antitrust lawsuit once morest Apple, and then appealed following losing the case. However, this time the U.S. Ninth Circuit Court of Appeals upheld the federal judge’s ruling, finding that Apple did not implement monopoly control, and once more sentenced Apple to win the case.
After the verdict came out, Apple described the result as a “huge victory,” noting that nine out of 10 lawsuits end in Apple’s favour. Apple also mentioned that the App Store will continue to promote competition and innovation, and is proud of its profound contribution to users and developers around the world.
Tim Sweeney, founder and CEO of Epic Games, said on Twitter that although Apple won the case, at least the appeals court retained the part of the 2021 ruling in favor of Epic Games.
