Earlier this month, we commented on an unfolding of the epic (no pun intended) feud between Apple it’s at Epic Games related to the involvement of Supreme Court of the United States in the imbroglio.
At the time, the Cupertino giant requested a review of the case to the country’s highest court to appeal a 2021 decision that prevents it from blocking links and buttons for payments outside the country. App Store in apps downloaded from the store.
Now, however, Epic also appealed to the Supreme Court requesting that the same (first instance) decision take effect immediately — which precisely forces changes in the functioning of the App Store —, as informed by Archyde.com.
In its appeal to the Supreme Court, Epic argued that Apple is using its power over its app store to fix prices in an “illegal and anti-competitive” way. Furthermore, the creator of the game Fortnite said that the main question is whether Apple (or any other technology company) can use its market power “to limit consumer choice and stifle innovation”.
We are ready to take our case to the Supreme Court to defend the freedom of people who buy apps and the freedom of developers to create and sell apps in an open and competitive marketplace.
When filing its request with the Supreme Court, Maçã had already argued that the decision limits its ability to “protect users once morest fraud, scams, malware, spyware and objectionable content”. However, the company has not yet commented on Epic’s most recent attack.
The Supreme Court has also not decided whether or not to uphold the case, but if it does, it might have significant implications for Apple — as well as consumers and developers alike.
