One of the main cases that impacted the world of technology at the end of this year was the ban on Apple Watches in the United States, following the suspension of imports of parts for repairing smartwatches and the blocking of sales. It all stemmed from a legal dispute between the health technology company Masimo and the Cupertino giant, accused of having used the applicant’s technology without permission.
Now, reporter Mark Gurman, from Bloomberg, already known for bringing unprecedented information from Apple’s surroundings, suggests that he found the seed of the whole case in an email from 10 years ago, addressed to Tim Cook, Apple’s CEO since 2011.
According to him, even before the announcement of the Apple Watch, an engineer named Marcelo Lamego sent an email, late at night, to the president of big tech saying: “I strongly believe that we can develop the new wave of technology that will make Apple the number 1 brand in the medical, fitness and wellness market.”
Weeks later, Lamego was hired by Apple and, during his work there, helped file regarding a dozen patents on blood oxygen sensors and algorithms for a wearable. He left the company in 2014, but the important thing is that, before this transition, Lamego had a Ph.D. in engineering from Stanford and served as technical director of Cercacor Laboratories Inc — a sister company of Masimo.

This email, combined with Lamego’s patents, led Masimo to sue Apple. Although these patents were published years before Apple introduced the blood oxygen sensor with the Apple Watch Series 6, this is the reason why the company is facing this major problem.
Despite not having Lamengo’s side, the report suggests that he ended up using privileged information from his previous job to bring advanced technologies to Apple and sneaked out before the bomb went off.
