Twitter has won its first victory in its lawsuit once morest Elon Musk following the judge in charge accepted his request to have the trial this same 2022.
At the hearing this July 19, the chancellor of the Court of Delaware, Kathaleen McCormick, agreed to the request Twitter to have an accelerated five-day trial starting this October.
Twitter 1 – Elon Musk 0, for now
Initially, Twitter wanted the trial to take place in September, in four days, so that Elon Musk fulfill its purchase contract for 44 billion dollars.
And, although it is not a precisely exact victory for the social network, it is close to what he expected as opposed to what the tycoon’s legal defense requested.
“Musk has been and remains contractually obligated to use his best efforts to close this deal,” said Musk’s lead attorney. Twitter, William Savitt, during the hearing. “What you are doing is the exact opposite: it is sabotage.”
Kathaleen St. Jude McCormick said Musk’s team “underestimates the ability of this court … to quickly process complex litigation.”
Elon Musk wanted a trial in 2023
Musk’s lawyers asked the court to delay the trial until February 2023. They stated that Twitter suddenly rushed to complete a lawsuit and force the acquisition following two months of alleged “delays and obfuscations” over requested data related to bots and other fake accounts.
According to Elon Muskthe trial issue is moving too fast considering that the agreement between Twitter and the tycoon maintained “an expiration date” of October 24.
“The core dispute over fake and spam accounts is critical to the value of TwitterMusk’s lawyers wrote during his first request, reiterating the billionaire’s opinion that led to the suspension of the purchase. “It’s also extremely fact-intensive and expert-intensive, it’s time-consuming, it’s time-consuming for discovery.”
For now, there’s a chance Musk may have to go through with the purchase before the year is out, no matter how much he regrets making the offer.
