Elon Musk sued OpenAI, along with its co-founders Sam Altman and Greg Brockman and related entities. He accuses the creators of ChatGPT of violating their original contractual agreements: seeking profit and not living up to the founding mission of the nonprofit, which was to develop artificial intelligence that advances humanity.
Musk, a co-founder and early backer of OpenAI, says that when Altman and Brockman convinced him to help found and fund the startup in 2015, they promised that it would be a non-profit organization. According to the founding agreement, OpenAI to the public “freely accessible” had to do its technology.

He claims that OpenAI and Microsoft incorrectly licensed GPT-4 despite agreeing that OpenAI’s AGI capabilities will benefit humanity.
With the lawsuit, Musk wants OpenAI to stick to its original mission and prevents the monetization of their technologies developed within a non-profit framework for the benefit of OpenAI executives or partners, such as Microsoft.
The lawsuit also asks the court to find that AI systems like GPT-4 and other advanced models under development actually constitute artificial general intelligence beyond the scope of the license agreements. Also, Musk also requests an accounting and possible refund from donations intended to fund research in the public interest, if the court finds that the nonprofit is now operating for private profit.
“Mr. Altman has chosen a new board that does not have the same technical expertise or any significant background in managing AI that the previous board originally possessed. Mr. D’Angelo, a tech CEO and entrepreneur, was the only member of the previous board who remained following Mr. Altman’s return. New board members more likely to have experience in for-profit businesses or politics than AI ethics and governance” the lawsuit adds.
