And one more. Élisabeth Borne once once more held her government responsible on Monday evening for the entire draft Social Security budget for 2023, including its expenditure part. This use of article 49.3 comes just a few hours following the failure of two motions of censure on the revenue side.

« Despite our desire for dialogue, no opposition group has wanted to deviate from its line: refusing to vote on a budget, whatever it may be. », Regretted the Prime Minister in a short speech from the podium of the Assembly. This is the fourth 49.3 since the resumption of parliamentary work in September and the 15th since the arrival in Matignon of Elisabeth Borne.

The main measures of the “ expenses »

To curb health spending, the government is aiming for a total saving of 3.5 billion euros in 2024, via reductions in spending on medicines, analysis laboratories and even sick leave.

The section on “ expenses » therefore includes controversial savings measures, such as the possibility of suspending an insured person’s daily allowances when a doctor mandated by his employer judges his work stoppage to be unjustified. Or the reduction in reimbursement for an insured person refusing shared medical transport. But the PLFSS also provides for consensual measures, such as reimbursement for reusable periodic protection for women under 26 or free condoms for those under 26. It also initiates an expected reform of fee-for-service pricing in hospitals.

As a reminder, the use of 49.3 allows the government to integrate the amendments of its choice, including its own, into the text for which it assumes responsibility. And, thanks to this tool, the executive has rightly announced that it wants to add “ expenses » the granting of a “ temporary status » of five years to therapeutic cannabis, pending an authorization decision from the European authorities.

Medical franchise, Agirc-Arrco… Measures that are still debated

Another measure of “ accountability » crystallized part of the debates, without even appearing in this PLFSS: the executive has not ruled out the envisaged doubling of the remainder payable by policyholders for medicines (currently 50 cents per box) and consultations (1 euro ). “ Indeed, the modification of deductibles and fixed contributions is envisaged », replied the Minister of Public Accounts Thomas Cazenave, questioned by deputies from the left and the right.

But the minister did not guarantee that this measure would be implemented, recalling that other avenues for savings existed, such as reducing drug prescriptions. And an increase in deductibles “ falls within the regulatory domain “, not from the PLFSS, he dodged.

Uncertainty also remains for another explosive measure: the possible contribution of Agirc-Arrco, the private supplementary pension fund. The government has certainly given up at this stage » to impose a drain on this system managed by the social partners. But without excluding tabling an amendment during the continuation of the budgetary debates, if employers and unions do not give guarantees “ fast ” of good will. According to a ministerial source, the executive then wishes “ achieve co-financing of minimum pensions », with a contribution from Agirc-Arrco of around 400 million euros for 2024.
