Elena Highton of Nolasco vs. Carlos Rosenkrantz: refuted his statements about needs and rights | “You know people and they didn’t surprise me”

The former judge of the Supreme Court of Justice, Elena Highton de Nolasco, said she was not “surprised” by the words of the vice president of the high court, Carlos Rosenkrantz, who days ago stated that “there cannot be a right behind every need.”

“I believe that where there is a need, there is a right. From there, there are resources to solve it, that is something else. But the need implies the right to solve it and we must try to ensure that this right exists and that it is fulfilled,” said in statements to the radio AM990. And he added: “You know people. I don’t want to comment on colleagues, but (these statements) don’t surprise me too much.”

Within the framework of a conference entitled “Justice, Law and Populism in Latin America”, organized by the University of Chile, Rosenkrantz expressed days ago: “There cannot be a right behind every need because there are not enough resources to satisfy all needs, unless we restrict what we mean by necessity or understand by right aspirations that are not legally enforceable”. The expressions received a wide repudiation.

On the other hand, Highton de Nolasco referred to the possibility of enlarging the Supreme Court of Justice and, in this sense, said that he did not think that “there should be a gigantic Court.” “I think it has to be a reasonable number, 20-odd doesn’t seem ideal,” he said, adding: “I’ve been in cuts of nine, eight, seven, six, five, four and three” .
