The first electronic signature service provider in Polynesia is operational. Fenua Sign offers administrations, professionals and individuals an online service that allows the generation of electronically signed, tamper-proof and legally recognized documents.
“The principles of electronic signature are very old, the protocols have existed for more than 20 years, and moreover in a former career I was in charge of electronically signing medical data”, says Cyril Vinh-Tung who worked for 11 years at Agfa Healthcare.
This legal validity took some time to be extended to Polynesia. Legal since 2014 for the private domain, the electronic signature is also legal for exchanges with the administration since the adoption of the law of the Country n ° 217-30 of November 2, 2017. But all forms of signature electronic do not have the same legal value. For example, documents signed by hand and then scanned, or signatures on a PDF document “drawn” on a smartphone, fairly common practices, have no real legal value. “because the cryptology protocols are not implemented”, says the co-creator of Country Signwhich modulates its packages according to the quantity of documents and the level of security applied: “simplified”, “advanced” or “qualified” signatures.
A technology older than the blockchain, but more « proven and with a more certain legal value”says Cyril Vinh-Tung.
“The law came out, but today in technical terms there is not yet a solution deployed, which is why we created the company. The target is the administrations, the municipalities, the State why not, but also the big private companies which attach importance to saving paper – I am thinking of our big operators, each time you move into a house you have to sign contracts everywhere to get a lease, water, electricity and insurance, for example. All these papers might be replaced by electronic signatures. In France, real estate transactions have been done by electronic signature for a long time.
