MEXICO CITY.- Joaquín Guzmán Loera “El Chapo”filed a motion of appeal before the Court, alleging that His extradition to the United States was “Illegal” and that his lawyers were not effective in his legal representation.
The handwritten motion, addressed to Judge Brian Cogan of the Eastern District Court in Brooklyn, New York, has an execution date of September 25, 2024.
In it, “El Chapo”, sentenced to life in prison, alleges that he was extradited “illegally to the United States.”
According to the former leader of the Sinaloa Cartel, “the extradition to the Eastern District Court of New York was illegal. I should have been extradited to the Eastern District of Texas and the Southern District of California. “There was never a waiver of the specialty rule, signed by a magistrate judge.”
“El Chapo” acknowledged that he had already presented this motion previously and it is not based on “new evidence discovered.” As a second argument, Guzmán Loera wrote “ineffective legal assistance.”
He explained that “my lawyers were ineffective. They did not properly examine the witnesses and, as a result, I was found guilty. They also did not fight to have certain evidence excluded from the case. Same thing with my appellate lawyer.”
The evidence, he assured, “is clear.” As with the first argument, he admits that this motion has been filed before, and has nothing to do with “new discovered evidence.” Therefore, “El Chapo” asks Cogan to hold “a new trial”.
In January 2017, Guzmán Loera was extradited to the United States. Two years later, on July 18, 2019, he was sentenced to life imprisonment. He is currently serving his sentence at the ADX Florence maximum security prison in Colorado.

The motion is announced at a time when two of Chapo’s sons, Ovidio Guzmán and Joaquín Guzmán, are detained in the United States, awaiting trial. Joaquín Guzmán handed over, in turn, Ismael “El Mayo” Zambadawho will also be judged by Judge Cogan.
