Many may remember the soap opera between Apple it’s at Authority for Consumers and Markets (ACM), an antitrust body in the Netherlands, which had decided last year that Apple was violating the rules on dating apps in the App Store, in order to require some changes to the app store.
These changes concerned the blocking of third-party payment systems, but supposedly also a requirement related to “Apple’s dominant position”. From then on, the agency began to fine Maçã weekly while such changes were not made — so that the total amount reached 50 million euros.
Apple opposed the fine, claiming that ACM had “overestimated its dominance in the dating app market and incorrectly defined the relevant markets.” Only now, however, the Dutch body disclosed having rejected Apple’s objections. The ACM’s decision would have been taken last July, but was recently published.
As the ACM denied the appeal, Apple said it will appeal to the Dutch courts. Regarding the suitability of the App Store to the body’s requirements, it has not yet been disclosed which elements of the ACM order that Maçã allegedly did not comply with, so they will be shared following the outcome of the legal dispute.
