Within the framework of the investigation into the insurance scandal contracted during the administration of Alberto Fernández, federal judge Julián Ercolini ordered the general inhibition of the assets of the former president, also of his friend the broker Héctor Martínez Sosa as well as his wife, the former secretary of the head of state María Marta Cantero. The resolution also included an extensive list of insurers that participated in the maneuver under investigation that focuses on the contracts of different State organizations with Nación Seguros SA.

Within the file, the possible existence of a criminal organization that “would have operated in the contracting of insurance by various state entities during the presidency of Alberto Fernández, and especially through the intermediation of individuals and companies between said entities and the insurer Nación Seguros SA; as well as the inclusion of co-insurance companies by it.”

In addition, the bank secrecy of the main defendants was ordered to be lifted, including Fernández, Martínez Sosa, his company and Cantero, who was also Alberto’s secretary. Another 30 individuals and legal entities are under investigation.

The case investigates the alleged irregularities that occurred around Decree 823/2021, through which Alberto Fernández imposed the obligation on the State Public Sector to contract insurance services exclusively with the company “Nación Seguros SA.

Among the central aspects that Justice questions is the fact that this decree enabled the hiring of intermediaries who received million-dollar commissions. In addition to this, it was suggested that the decision made by Alberto Fernández prohibited the possibility of holding public tenders. Later, the possibility of giving participation to other insurers in the form of coinsurance was established.

It is in this last stage that “a large part of those contracts, whether necessary or not, had the participation of intermediaries and organizers (both natural and legal persons) among whom are, among others, Héctor Martínez Sosa, Pablo Torres García and Oscar Castello.

For this, the firms Héctor Horacio Martínez Sosa y Compañía SA were used; TG Broker SA; Bachellier SA; Castello Mercuri SA and San Ignacio Sociedad de Productos Asesores de Seguros SA “They were paid commissions that, according to what was reported, would be higher than those of the market and/or they would have been appointed by the respective public departments through an irregular or non-existent or directed selection process ”states the resolution.

According to the research, these five firms “are at the top among the intermediaries that received the highest commissions from 2020 until the study was carried out.” These are Bachellier, in first place, Héctor Horacio Martínez Sosa y Compañía, in second place. It is followed by Castello Mercuri, then San Ignacio Society of Insurance Advisory Producers and in fifth place, TG Broker.

According to what is indicated, together the five accumulate $2,782,170,946 in commissions from Nación Seguros during the period in question, out of $3,453,302,777 pesos of the total number of producers, representing more than 80%.

Therefore, the judge decided to extend the time window in which the alleged irregularities under investigation would have been committed. Now, the entire Fernández presidency is covered because the existence of “said intermediations between both contracting parties prior to the issuance of the aforementioned decree” was determined.
