The states of the United States have different requirements to grant a driver’s license to undocumented immigrants. There are some states that grant permission to drive to immigrants in the process of legal proceedings.
Other states prohibit authorization to drive for aliens without papers. The Tenth Amendment empowers states to make their decisions without contradicting federal law.
There are 19 states in addition to the District of Columbia, which issue authorization to drive undocumented immigrants. These states include California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maryland, Massachusetts, Minnesota, Nevada, New Jersey, New Mexico, New York, Oregon, and Rhode Island.
There are also Utah, Vermont, Virginia and Washington that approve the driving request for the undocumented foreign population. Those interested must present personal information, such as the birth certificate, passport and proof of the home where they live.
An unfavorable law is coming in Florida
On July 1 of this year, various legal orders that favor undocumented immigrants will begin to take effect in some states. But in Florida that same day, a law passed by Governor Ron DeSantis will take effect.
This measure establishes the cancellation of driver’s licenses, obtained in the rest of the states by foreigners in the immigration process. Two years ago, more than 232 million people were driving in the country.
California issued the highest number of driver’s licenses in 2021, with 27 million. The second place was occupied by Texas, which disposed of an amount greater than 18 million.
Florida ranked third with more than 16 million driver’s licenses. In that order, New York follows, which granted driving licenses to nearly 12 million inhabitants.
Washington was the first of the states to give its consent in 1993, so that the undocumented might drive. In 2023, the state of Minnesota was the last to allow immigrants without legal status to have permission to drive.
