Driving laws in Pakistan, their enforcement and penalties for violation

Karachi This week in Karsaz area, a woman crushed two people with an uncontrolled vehicle. A father and a daughter lost their lives in this incident while at least four people were injured.

After the incident, there is once again a debate in the country as to what the legal punishment can be for such recklessness that has claimed a life on the road.

Penalties of Pakistan

Penal Code of Pakistan or Pakistan Penal Code (PPC) prescribes punishments along with formal definition of offences.

According to Section 320 of this Act, if a person is driving recklessly and in the process hits a person, causing his death, then Section 320 will be applicable.

According to Section 320, the perpetrator of this crime has to be executed and can be imprisoned for up to ten years.

Section 337G of the Pakistan Penal Code states that if a person is driving negligently, due to which he has hit someone, which did not result in the death of that person but caused him injury or any If the limb is lost, then the punishment is five years imprisonment.

No penalty was mentioned in this section.

Section 322 of the same law states that in case of murder due to reason, the killer will have to pay dowry.

Under Section 279 of the Pakistan Penal Code, if a person is driving recklessly in a public place and may cause danger to someone, even if he does not harm anyone, the police can file an FIR against him. and may be punished with imprisonment for a term of two months to two years or with fine or with both.

This law does not mention having a driving license or not. However, usually the police themselves add Section 320 to the FIR. During the investigation or during the hearing, if the criminal produces his driving license, the police converts it under Section 322.

Provincial Motor Vehicle Ordinance 1965

According to the second chapter of this law, driving without a license cannot be done.

Section 101 of the Provincial Motor Vehicle Ordinance 1965 mentions being mentally or physically unfit to drive, even in this case the offender is not exempted but fined.

Section 99 of the same law stipulates that driving over the speed limit is punishable by up to six months with a fine, while for a transport vehicle the punishment can extend to a period of one year.

Fatal Accidents Act 1864

Under this law, if the death of a person occurs due to the negligence, wrong action or default of a person, then under this law, the parents, husband or wife and children of the deceased have the right to claim the murder case. I should file a case in civil court and demand damages. The court determines the amount of damages and the damages are divided equally among the dependents.

Legal experts say that the punishments for crimes committed by drivers in traffic accidents are not severe because such accidents fall under the category of involuntary manslaughter, meaning that no one is intentionally targeted.

Recently, laws have been made to prevent underage driving. But from the point of view of the traffic police, it is not possible to determine this age and mental state by stopping every person driving on the road.

Therefore, after fatal accidents, the driver or the driver tries to find a way to escape the punishment by making some excuse.

The penalties for the driver in traffic accidents are not severe because such accidents fall under the category of involuntary manslaughter, i.e. no one is intentionally targeted.

In the event of someone’s death in an accident, there is a provision in the law that forgiveness can also be obtained by paying the price of blood.

The value of the dowry varies and is fixed by the government every year.
