The duration of the working day is shortened by one hour for all employees, i.e. those working full-time and part-time, in the total working time accounting mode, on duty, etc., who are not entitled to work reduced working hours according to the procedure established by legal acts, states the State Labor Inspectorate.
Taking into account the principles of fair payment for work, justice, honesty and reasonableness, the shortened pre-holiday hours for employees must be paid at the wages specified in the employment contract.
Meanwhile, when working on a public holiday, the employee must receive double pay.
VDI draws attention to certain provisions for shortening the duration of the pre-holiday working day:
- if for objective reasons it is not possible for employees to shorten the duration of the working day by one hour, for example, there is continuous work in the company, due to other peculiarities of production, work performance, this hour should be counted as overtime work;
- if the employee and the employer have concluded an agreement on additional work, for example, the employee works in several positions at the same employer, the total duration of the employee’s working day is shortened by one hour, not separately for each position;
- if an employee starts work on the eve of a holiday and ends on a holiday, the duration of the working day on the eve of the holiday must be shortened by one hour, for example, if the start of work is scheduled at 4 p.m., due to the reduction of working time, the employee would start work at 5 p.m.
