Andrzej Duda has appointed the chairman of the assembly of judges of the Civil Chamber of the Supreme Court. From the resolution published on August 27 in Polish Monitor it turns out that Krzysztof Andrzej Wesołowski was chosen. As indicated by the portal OKO.PressPiS has constructed the regulations so that among the three candidates presented to the president there is at least one neo-judge. In this case, he was indicated by Andrzej Duda. However, Prime Minister Donald Tusk also has a say in the selection of the chairman.

Donald Tusk approved the election of a neo-judge as chairman of the Civil Chamber of the Supreme Court

As can be seen in Monitor Polski, the resolution was signed by Donald Tusk, which approves the candidacy of the new judge. The lack of consent from the prime minister would block this choice and as a result the term of office of the current chairwoman, the new judge Joanna Misztal-Konecka would end in September. However, as OKO.Press journalists pointed out, then her duties would be taken over by the most senior judge chairing one of the departments of the civil chamber, who is also a new judge.

The scenario in which Donald Tusk would not approve the choice of Andrzej Duda gave the government hope that the assembly could be convened and a new person elected to this position could take place in 2025 after the presidential elections. However, the prime minister’s countersignature means that the new chairman will hold his position for another three years.

– The situation is a complete surprise. An extremely negative surprise. Firstly, the Prime Minister of the Coalition, together with the President, appoints a neo-judge to any function on 15 October. Secondly, this decision paves the way for the re-election of a neo-judge as the President of the Civil Chamber of the Supreme Court. Instead of acting to solve the huge problem with the Supreme Court, Donald Tusk is temporarily concretizing the PiS pathology in the Supreme Court with this countersignature – said the President of Iustitia, Judge Krystian Markiewicz, in an interview with OKO.press.

The prosecutor also spoke on the matter. Ewa Wrzosekwho opposed the judicial reforms introduced by PiS. She stated that “you can’t have your cake and eat it too”. Prof. Ewa Łętowska, a retired judge of the Constitutional Tribunal and the Supreme Administrative Court, also expressed her dissatisfaction in an interview with On Onet. – I really don’t like this decision of the prime minister. Or maybe it’s unwise. Or maybe it was some kind of political bargain, I don’t even want to think about what kind – said the expert and pointed out that “this whole situation simply makes anyone disinclined to take any action related to restoring the rule of law”.
