This Tuesday an appeal for protection was filed once morest the Minister of EnvironmentMaisa Rojasin her capacity as president of the committee of ministers that tomorrow will decide whether to approve or reject the Dominga port mining project.
This judicial action was presented by the shellfish diver, Jorge Carrera, who is represented by the lawyer Marcelo Castillo.
The document aims to denounce the constitutional rights instilled in fishermen who are in favor of the installation of the Port-Mining project, favorably evaluated by the Coquimbo Regional Environmental Commission and reviewed by the Supreme Court.
The claim to the Santiago Court of Appeals points out that the rights of workers in the area have been violated by the Secretary of State, by not disqualifying herself from the committee of ministers that tomorrow decides the future of Dominga.
This, despite having issued an opinion contrary to the project during the campaign of the current president Gabriel Boric, and his supposed friendship and professional ties with the lawyer of the oceana foundationEzio Costa Cordella, an organization that questioned the project before environmental institutions and in the courts of justice.
Sunday Project
The appeal for protection, prepared by the lawyer Marcelo Castillo, denounces that the refusal of Minister Rojas is an “illegal and arbitrary act” that “disturbs the right to equality before the law and not to be judged by special commissions, rights that are recognized in numbers 2 and 3, paragraph 5 of article 19 of the Political Constitution of the Republic”.
In the brief, the Santiago Court of Appeals is requested to issue an “Order Not to Innovate” tomorrow, that is, that the capital’s appellate court order the Minister of the Environment to refrain from resolving the Dominga project , while this protection appeal is being processed.
