The Ministry of Agriculture published the project that provides limitation of the commercial addition for certain foods for 90 days.

How to cap the commercial allowance

the commercial surcharge applied by the processor can be a maximum of 20%, compared to the production cost of the product, calculated according to the accounting regulations in force, in which direct and indirect expenses are included; the commercial surcharge applied cumulatively on the entire chain of distribution, regardless of the number of distributors in the chain, can be a maximum of 5%, compared to the purchase price to which the operational expenses are added; the commercial surcharge applied by the merchant for retail sales and cash&carry can be a maximum of 20%, compared to of the purchase price, to which the direct and indirect expenses of the merchant are added; rebates and rebates will also be included in the maximum commercial markup of 20%

Commercial surcharges are applied to the VAT-free value of the provided agricultural and food products.

Companies will have to modify, within 30 days (from the entry into force – depends on when it is adopted and published in the Official Gazette) the ongoing commercial contracts whose terms and conditions are contrary to the provisions.

The list of agricultural and food products that should become cheaper for 3 months

1. Plain white bread weighing between 300g-500g, without specialities

2. Fresh cow’s milk 1L, fat 1.5%

3. Telemea cheese from bulk cow’s milk

4. Plain yogurt from cow’s milk, 3.5% fat, with a maximum weight of 200 grams

5. White wheat flour “000” 1 Kg

6. Sift 1 kg

7. Chicken eggs caliber M 10 pcs.

8. Sunflower oil 1L

9. Fresh chicken meat

10. Fresh pork

11. Fresh vegetables in bulk

12. Fresh fruit in bulk

13. Fresh white potatoes in bulk

14. Cast white sugar 1 Kg

What fines can companies that do not comply with the ordinance receive and who will give them

Failure to comply with the provisions constitutes a misdemeanor, unless it was committed under such conditions that, according to the criminal law, it constitutes a crime.

Contraventions are sanctioned with a fine from 100,000 lei to 2 million lei.
