Are you having trouble bringing your spouse to Spain? In this article, learn how to avoid refusals at the Consulate in Havana.
In a recent live broadcast on YouTube, Estela Marina, CEO and founder of Grupo ARISTEO, explained a key process for Spanish citizens who have obtained their nationality through the Law of Democratic Memory or the Law of Historical Memory. It is of interest to those who wish to move to Spain with their foreign spouses, without having to present the marriage at the consulate.
“I want you to know that, for those people who have obtained Spanish nationality through the Law of Democratic Memory or the Law of Historical Memory, and want to come to live in Spain with their spouse… they have the right, yes or yes, to present a visa for a family member of a citizen of the Union for their spouse at the consulate, without the marriage having to go through the consulate.” He stated Marina in her live performance.
Procedures for foreign spouses in Spain
The expert stressed that this process applies to civil marriages celebrated in countries such as Cuba, Venezuela, Mexico, Colombia or Argentina.
According to Marina, “you can complete the marriage registration process here at the Central Civil Registry through a specialized office… This is not binding for your spouse to obtain a visa.”
That is, you can first apply for a visa and then, once your spouse arrives in Spain, you can manage the rest of the process.
This simplified procedure gives spouses of Spanish citizens the possibility of starting work immediately. “Spouses can work once they have requested their residency file, with proof of the file and with their assigned NIE number… Even if the marriage is in process, you can work,” said the CEO of Grupo ARISTEO.
Denials at the Consulate in Havana
The advice comes amid recent obstacles. Estela Marina warned in the same live broadcast about a worrying pattern of denials at the Spanish Consulate in Havana.
According to the expert, “denials are being issued under the pretext that the marriage is fraudulent.” Consular officials have detected alleged inconsistencies during hearings, which has led to the denial of applications.
