In 2020, Peter, a Belgian from Flanders, called on the travel agency Enjoyce Travel to organize his vacation in Jamaica: “We paid 1,500 euros in advance. But a little later the corona pandemic broke out and the tour operator TUI had to cancel our trip, ”he says in an interview with Het Belang Van Limburg.
But the story does not end there. In June of the same year, the Enjoyce Travel agency was declared bankrupt. TUI had promised Peter, and dozens of other travellers, a valuable voucher with which they might book another trip. The latter refused the offer: “TUI then reimbursed 300 euros. According to TUI, the remaining 1,200 euros should be reimbursed by the insolvency insurer MS Amlin”. According to the insurer, it is not up to him to pay, but TUI.
TUI condemned to pay
Two years later, none of the people involved in this case has yet been reimbursed. A couple of travelers called on a lawyer who sued TUI and MS Amlin and the decision was favorable to them: “
TUI was ordered to pay the 1,200 euros. They have been reimbursed. Do I also have to go to court to get my money back? I’m also entitled to it, right?
asks Peter.
According to the judge, the trip of these tourists was canceled due to the coronavirus, and not due to the insolvency of the travel agency. It is therefore up to TUI to pay. A word of advice: if you prefer to book through an intermediary rather than with TUI, choose a travel agency that is financially stable, this will save you the trouble that Peter and other travelers have encountered during the pandemic.
