– There were several things that were not in order at all during the inspection visit there, states Rune Asmussen, director responsible for engineering and the environment at Frederikshavn Municipality.

– What makes us take such a drastic step as a closure order is about the building permits – more precisely the fire-technical and safety conditions in the building. It is clear that when an inspection such as this summer finds that the conditions are not in order, then we have to say that we cannot stand for that, states Rune Asmussen.
– For a year, we have been in dialogue with the owners about getting the necessary applications sent to the municipality, so that we could legalize what is going on out there. We got those applications in the spring, and only then do we go in to deal with the cases on merits, because then we know what we have to deal with, says the director of engineering and environment.
It is also only then that the municipality’s case handlers take on supervision at Essens Gaarden.
– This is where we can ascertain that there are some things that are just not right. And we cannot sit idly by. So we have tried to be pragmatic and actually very long-suffering, but then of course it becomes a bit violent when we can observe things during a visit that we simply have to react to, he says.

– There is no control over the permits in relation to the Planning Act. It is both about a land zone permit, it is about exemption for construction near ancient monuments, and it is about the Environmental Protection Act with regard to the diversion of waste water from the site. At the same time, he emphasizes that it is not construction too close to a historical monument and, for that matter, not the lack of a zoning permit that has led to the closure order.
– We could have done that, but what hits the nail on the head is the construction case and the construction safety conditions, states Rune Asmussen.
