As part of the continuation of the trial of former Minister of Defense Dr. Mohamed Diané, the judge rendered his decision on the exceptions raised, by Maitre Ciré Cledor Ly. The latter had wanted the proceedings before the CRIEF to be suspended until the Supreme Court rules.

The defendant’s lawyer had raised two (2) exceptions, the unconstitutionality of the procedure and the unconventionality before the Supreme Court. In clear terms, the procedure would violate on the one hand the Guinean Constitution and on the other the international conventions ratified by the country.

At the end of the debates, the judge, Francis Kova Zoumanigui rendered his decision. He decides to postpone the trial, the time for the Supreme Court to rule on the objections raised by Maître Ciré Cledor Ly.

“Given the provisions of article 733 of the code of criminal procedure, the Court orders a stay of proceedings until the occurrence of the decision of the Supreme Court on the objections raised and the transmission of the file to the Supreme Court for this purpose. . Such is the measure,” he said.

As a reminder, Dr. Mohamed Diané is being prosecuted for alleged acts of embezzlement of public funds, illicit enrichment and complicity by the Court of Repression of Economic and Financial Offenses (CRIEF). He has been placed under a warrant of committal in the central prison of Conakry since April 6, 2023.
