Detainee Released Due to Legal Error: Murder Victim’s Family Seeks Justice

A detainee, sentenced in 2022 to 18 years’ imprisonment for murder and pending his appeal trial, was released on Thursday, we learned on Friday from the Rennes general prosecutor’s office, confirming information from the daily Ocean Press.

The man had been sentenced at the end of May 2022 by the Loire-Atlantique Assize Court to 18 years in prison for having shot and killed a 34-year-old man in 2018 and he had appealed.

The Assize Court of Morbihan was appointed to retry it but, due to a heavy workload, this appeal might not be examined within one year following the first assize trial as required by law. , explained in a press release the general prosecutor’s office.

“The request for an exceptional extension of the pre-trial detention had to be submitted to the investigating chamber of the Rennes Court of Appeal, in the month preceding the expiry of the period”, details the institution.

“Following an error in the seizure of the investigating chamber by the general prosecutor’s office, within this legally imposed period, this accused might not be kept in detention and was released at midday on June 1”, specifies the general prosecutor’s office.

The murder had taken place “in a case of settling scores between rivals involved in drug trafficking, located in the sensitive Bellevue district of Nantes”, recalls the press release.

The relatives of the victim “are dejected, amazed and extremely distressed. They wonder how such an error might have occurred for facts of such magnitude”, lamented the defender of the family, Me Franck Boëzec.

“My clients are asking extremely basic questions, continued the lawyer. What will happen now? Will he put pressure, or even worse, on the victim’s family (.. .)? Will he flee? Will he be present at his appeal trial?

The lawyer indicated that he had “asked the public prosecutor for protection for the victim’s wife and two sisters”, as well as referral to the investigating chamber (…) so that he would at least be placed under judicial review pending appeal.

For Me Yassine Yacouti, lawyer for the released detainee, this decision “corresponds to the rules of procedure”.

“My client will be keen to defend himself for his appeal trial when the time comes,” he added.
