On the 29th, the Democratic Party of Korea and the People’s Power clashed once once more over the formation of a special committee on judicial reform in the National Assembly, which will deal with the establishment of the so-called ‘Serious Crime Investigation Agency’, which will take over the direct investigation authority of the prosecution. The people’s power protested that it was a “legislative dictatorship,” but the Democratic Party, which effectively independently handled the proposal for the creation of a private special committee at the National Assembly Steering Committee on that day, plans to push it until the plenary session on the 3rd of next month.
The Democratic Party convened a plenary session of the steering committee on the followingnoon of the same day and proposed a resolution to form a private special committee, and then voted with only members of the Democratic Party and Justice Party participating. In Power of the People, only Rep. Song Eon-seok, secretary of the steering committee, attended and protested and then left. Rep. Song said, “It was clear that he did not agree with the opening itself, but he forcibly convened the steering committee.”
However, Democratic Party floor leader Park Hong-geun, who is the chairman of the steering committee, announced the approval of the constitution within 50 minutes of the meeting. The reason why the Democratic Party continued its monopoly until the formation of a private special committee is because the establishment of the Heavy Suspension Office is essential to completely abolish the power of direct investigation by the prosecution. Earlier on the 22nd, the ruling and opposition parties agreed to launch the heavy investigation agency within 1 year and 6 months following the formation of the special committee on private affairs, and to abolish the prosecution’s right to directly investigate the two major crimes (corruption and economy) following the establishment of the agency.
Floor Leader Park asserted, “There are no procedural flaws (in the convening of the steering committee).” The Democratic Party plans to process the amendment to the Prosecutor’s Office Act at the plenary session on the 30th, and finish processing the amendment to the Criminal Procedure Act at the plenary session on the 3rd of next month and to propose the composition of the private special committee.
On the other hand, floor leader Kwon Seong-dong of People’s Power said, “Because the Democratic Party has already opposed the arbitration plan of the National Assembly Speaker, the bipartisan agreement including the formation of a private special committee is null and void.”

The Democratic Party, which is pushing the so-called ‘completely deprived of the prosecution’s investigation authority’ bill, held the National Assembly Steering Committee on the 29th to discuss the establishment of the Serious Crime Investigation Agency (tentative name) and dealt with the constitution of the National Assembly Judicial Reform Special Committee. The People’s Power did not participate at all, saying, “We do not agree with the opening of the agenda itself.”

The People’s Power lawmakers did not appear on the steering committee on the day convened by floor leader Park, who serves as the chairman of the steering committee. Only Rep. Song attended, blaming the tyranny of the Democratic Party, and then left the conference hall. Afterwards, Democratic lawmakers, independent lawmaker Min Hyung-bae, who disguised himself as a Democratic Party member, and Justice Party floor leader Bae Jin-gyo remained and decided on the composition plan, and the meeting took place within 50 minutes of the start of the meeting.
According to the draft dealt on that day, the special committee on private affairs will have 13 members including the chairman (7 members of the Democratic Party, 5 members of the People’s Power, and 1 member of the non-negotiating group), and the period of activity is until December 31 of this year. After the steering committee ended, floor leader Park said, “If (the people’s power does not make a list of members), the doors will open as soon as they did not. no,” he said.
The Democratic Party has taken another solo initiative of forming a private special committee despite the opposition from the people, with the intention of depriving the prosecution of its rights to directly investigate the two major crimes (corruption and economy), which are maintained for a limited time. On the 22nd, the ruling and opposition parties decided to ‘complete the legislation within six months of the establishment of the special committee on the private sector, and launch a heavy water agency within one year following the completion of the legislation’ in the arbitration bill of National Assembly Speaker Park Byeong-seok on the 22nd. However, as such content was omitted from the bill referred to the plenary session of the National Assembly on the 27th, concerns that “the prosecution’s authority to directly investigate the two major crimes might continue” emerged, so they hastily decided to form a private special committee.
The Democratic Party plans to take the matter of forming a private special committee at the plenary session on the 3rd of next month. On the same day, floor leader Park said, “I am asking the Speaker of the National Assembly so that it can be dealt with at the plenary session.” Following the amendments to the Prosecutor’s Office Act and the Criminal Procedure Act, the intention is to complete the legislation of ‘Complete Inspection’ by processing the proposal for the formation of a private special committee.

However, problems with the Democratic Party’s hasty legislation continue to surface. Right away, the Democratic Party introduced a ‘self-correction’ that changes the contents of the bill passed by the National Assembly Judiciary Committee at dawn on the 27th, and the bill that was later referred to the plenary session of the National Assembly. In the process, the provisions related to the prosecution’s right to investigate the two major crimes were changed from ‘corruption/economic crimes, etc.’ to ‘under corruption/economic crimes’, and returned to ‘etc.’ just before the assumption. The regulations related to the prosecution’s complementary investigation have also been changed from ‘the scope of the same criminal facts’ to ‘the scope that does not impair identity’.
In response, the House of Representatives delegation from the People’s Power held a press conference on the same day and said, “Amid the legislative rush of the Democratic Party, only for the Democratic Party, and only the Democratic Party, the Democratic Party’s original bill, the arbitration plan for the Speaker of the National Assembly, the Democratic Party’s amendment for the Judiciary Committee, and the Democratic Party’s self-amendment for the plenary session were made in haste. However, the Democratic Party is highly likely to be consistent with the remaining procedure as a ‘trick’. Article 72 of the National Assembly Act stipulates that the plenary session on Saturday should be held at 10 a.m., but the Democratic Party took the strategy of holding a plenary session at 4 p.m. on the 30th. There is also an analysis that the intention is to minimize the filibuster (unlimited discussion) time at the plenary session. The plenary session is scheduled to be held at 2 pm on weekdays, but the Democratic Party is also considering holding the plenary session in the morning on the 3rd of next month. An official from the Democratic Party said, “As the State Council meeting is held at 10 a.m., I understand that they are considering both ways to advance the plenary session before that or to postpone the State Council meeting to the followingnoon.”
