Delhi Administrative Control Bill: Rajya Sabha Passes the Bill with 131-102 Votes

New Delhi: The Rajya Sabha also passed the Delhi Administrative Control Bill. 131 members voted in favor of the bill. 102 voted against. Home Minister Amit Shah criticized the opposition parties and AAP who opposed the bill. Amit Shah himself introduced the bill in the House.

The bill was passed in the Rajya Sabha with the support of Andhra Pradesh Chief Minister Jagan Mohan Reddy’s YSR Congress and Odisha Chief Minister Naveen Patnaik’s BJD. Both parties have nine members in the Rajya Sabha.

In the Rajya Sabha, which currently has 238 members, the support of 120 people was required to pass the bill. Although the total strength of the assembly is 245, seven seats are vacant. The NDA, which includes the BJP and its allies, has 103 members. Besides the support of YSR Congress and BJD, the BJP got the support of five nominated members and an independent MP.

Amit Shah said that the Delhi Administrative Control Bill does not in any way violate the Supreme Court verdict. “Delhi decentralization bill will not violate Supreme Court verdict. This bill is to ensure good and corruption-free governance in the national capital,” said Amit Shah. He said that this bill was brought for the first time when the Congress came to power and not a single line has been changed from it. They are now opposing the bill brought by the Congress itself along with the Aam Aadmi Party. He said that Congress is now sitting in the lap of AAP.

Amit Shah also accused the Delhi government of trying to destroy the file of corruption cases. There was a move to destroy the files related to the construction of the Chief Minister’s residence and the liquor policy scandal. Amit Shah said that the bill aims to eliminate the corruption of the Delhi government. Amit Shah said that the NDA government is not bringing the amendments to implement emergency and Congress has no right to talk about democracy. The bill was passed in the Lok Sabha last week amid opposition uproar.

A constitution bench of the Supreme Court had ruled that the powers of control over the officers appointed in various departments of the Delhi government rested with the government elected by the people and services other than law and order, police and land in the National Capital Territory (NCT) were under the jurisdiction of the government. The central government brought the bill to overturn this ruling in favor of the Delhi state government.

On May 19, the government introduced a special ordinance (Government of National Capital Territory (Amendment) Ordinance 2023) to constitute a special authority for appointment and transfer of civil servants under the Delhi government. The newly formed National Capital Civil Service Authority has the Chief Minister, Chief Secretary and Principal Secretary, Home Department as its members.
