Questions Raised Over Maradona‘s Death Scene: Lawyer Alleges Tampering
Diego Maradona’s death continues to spark controversy, with the former soccer star’s legal team raising concerns over potentially tampered evidence at the scene of his passing. Rodolfo Baqué, the lawyer representing nurse Gisella Madrid, who was tasked with caring for the Argentine legend, is alleging that photos taken inside Maradona’s home shortly after his death show a suspiciously tidy room.
“Diego died at 1:00 p.m. (4:00 p.m. GMT), and by 4:00 p.m. (7:00 p.m. GMT), there were already alterations on the scene,” Baqué stated, expressing his suspicions about the state of the room in the photographs.
Baqué elaborated on his client’s actions during the critical moments following Maradona’s death, revealing she spent just over an hour attempting to revive him alongside a security guard who performed mouth-to-mouth resuscitation.
“Other doctors and paramedics had been there, along with a lot of other people who couldn’t have messed up the scene,” explained Baqué in statements made to channel A24.
Adding to the legal complexities of the case, another lawyer, Mario Baudry, who represents Verónica Ojeda, the mother of Maradona’s son “Dieguito” Fernando Maradona, has also entered the fray.
Baudry, echoing concerns about the evidence, stated, “The evidence (photos) that is in the file is what prosecutors consider useful to make an accusation.”
At this point, neither the court nor the prosecutor’s office investigating Maradona’s death has confirmed or denied these allegations of tampering.
The Buenos Aires Court of Cassation issued a ruling on October 2nd, stipulating that responsibility for Maradona’s death will be determined in two separate trials. The first trial will involve a jury, specifically targeting the nurse at Baqué’s request, though no start date has been set. The second trial, which will address the remaining seven defendants, is scheduled for March 11, 2025.
While uncertain about the nurse’s fate regarding a jury trial, Baqué admitted the same could apply to the other seven professionals implicated in the case.
The remaining defendants are a diverse group of medical professionals, including neurosurgeons Leopoldo Luque, psychiatrists Agustina Cosachov, psychologist Carlos Díaz, nurse Ricardo Omar Almirón, clinical doctor Pedro Di Spagna, and doctor Nancy Forlini, who coordinated Maradona’s home care.
Maradona is reported to have died of “acute pulmonary edema secondary to exacerbated chronic heart failure,” according to the autopsy, which also revealed “dilated cardiomyopathy.”
The trial against the team responsible for Maradona’s care during his final days is slated to begin in March. It is expected that the case will delve deeply into the circumstances surrounding the soccer legend’s death, umfassend the potential for medical malpractice.
Why is the time difference between Maradona’s death and the photographs showing an altered scene significant?
## Questions Raised Over Maradona’s Death Scene: A Lawyer’s Perspective

Joining us is Rodolfo Baqué, the lawyer representing nurse Gisella Madrid, who was caring for Maradona at the time of his passing. Mr. Baqué, thank you for being here.
**Rodolfo Baqué:** It’s my pleasure to be here.
**Interviewer:** Mr. Baqué, there have been allegations of potential tampering at the scene of Maradona’s death. Can you elaborate on these concerns?
**Rodolfo Baqué:** Absolutely. We have serious concerns about the state of Maradona’s room in photographs taken shortly after his death. The room appears suspiciously tidy, which seems inconsistent with the chaotic nature of a medical emergency.
**Interviewer:** You mentioned the time frames involved. Can you clarify what raised your suspicions?
**Rodolfo Baqué:** Diego Maradona passed away around 1:00 pm local time. However, by 4:00 pm, photos show a significantly altered scene. This timeframe raises serious questions about who had access to the room and what they might have done during those crucial hours.
**Interviewer:** What about your client, Nurse Madrid? How did she react to Maradona’s medical emergency?
**Rodolfo Baqué:** Nurse Madrid acted swiftly and professionally.
She immediately initiated CPR and continued for over an hour, assisted by a security guard who also performed mouth-to-mouth resuscitation.
**Interviewer:** So, you’re saying despite other medical personnel and individuals present, you believe Nurse Madrid acted appropriately?
**Rodolfo Baqué:** Absolutely. Nurse Madrid, along with the security guard, was present throughout the resuscitation efforts. Multiple other medical professionals and paramedics were also at the scene. It’s perplexing to see such a tidy picture emerge so soon after such a significant event.
