The deconjugalization of the allowance for disabled adults was voted by Parliament on August 16, 2022. Since then, the State services and the competent social security funds have mobilized for the implementation of this reform. A new stage has been launched with the deployment of a “go-to” campaign.
Deconjugation allows people with disabilities to obtain a disabled adult allowance calculated on the basis of their individual resources alone, without depending on those of their spouse: 120,000 disabled people who live as a couple (including 80,000 potential new beneficiaries to the AAH) will therefore see their allowance increase by €350 per month on average.
As the Government had promised, a mechanism will make it possible to guarantee that this reform results in no losers. To do this, the following principles have been set out in the implementing decree:
– The change of calculation method will only take place if it is to the benefit of the persons concerned. If not, the current system will continue to apply.
– Deconjugation is automatic if it is favourable, on the basis of calculations made by the family allowance funds (CAF) or the Mutualité sociale agricole (MSA). The CAFs and MSAs will have to determine which beneficiaries are eligible to switch to the new system. A comparison will be made at each change of situation, to check which of the two calculation methods is the most favourable.
– Deconjugalization is final: once an allowance is individualised, it is no longer possible to take the spouse’s income into account.
– From October 1, 2023, the calculation of the AAH will be deconjugalized for new entrants to the system.
The next step will be the entry into force of the reform with the effective deconjugalization of the AAH from October 1, 2023.
To enable as many people as possible to benefit from these new rights, the Government and the National Family Allowance Fund have launched a “go-to” campaign, aimed at people who are now eligible for AAH thanks to the reform . They will be invited to update their administrative situation on the CAF and MSA websites. So that everyone understands their situation, communication and awareness-raising actions will be disseminated in departmental centers for disabled people, family allowance funds and associations. The objective is to mobilize all communication channels to avoid non-use of the law as much as possible.
