Justice acquitted all those accused in the case of covering up the death of the journalist Débora Pérez Volpin. The accusation was against Roberto Martingano, the former medical director of the Trinity Sanatorium, and Miriam Frías, an instrument worker. This was the second trial that was carried out for the death of the journalist that occurred on February 6, 2018 at the Sanatorium de la Trinidad, in Buenos aires city.

Chord specified LN+, the journalist’s family heard the verdict and left in silence, totally dissatisfied. Together with the prosecution, they will appeal the resolution of the case. The defenses, for their part, celebrated the ruling and insisted that there were no crimes. Through lawyer Diego Pirota, they had requested convictions for concealment for the former medical director with a sentence of three years in prison and 10 years of disqualification. For Frías, three years were requested for false testimony.

In addition, it was requested to extract testimonies for the crime of procedural fraud, because there are clear indications that the documentation provided to prove the purchase of the endoscopic equipment was “false, armed, fabricated.” The prosecution, meanwhile, also requested three years for Martingano and two years for Frías. The defenses demanded acquittal.

“They are going to have to work hard to substantiate this sentence,” said Pirota. “Logically we are going to appeal the ruling. The Supreme Court confirmed the sentence for which this trial was opened. “An important opportunity to be brave was lost today.” The prosecution will also appeal the resolution. “We are going to appeal. It’s a surprise. We thought they were going to convict. “It really is a surprise,” she added.

The event

Débora Pérez Volpin was 51 years old when she was admitted to the sanatorium due to severe stomach pains, for which the doctors could not find an explanation. Upon entering the operating room, she spoke with the anesthetist. She then fell asleep and never woke up again.

The intervention carried out by the endoscopist Diego Bialolenkier was the cause, as confirmed by the Supreme Court ruling, of the journalist’s death, and he was sentenced to three years for “wrongful homicide.” In August 2019, a court led by Judge Javier Anzoátegui established that the journalist died due to the “reckless and negligent conduct” of the endoscopist doctor during the “upper digestive video endoscopy” procedure.
