Two types of claims may be made under this class action: one for loss of time and the other for theft of data.

Those wishing to make a claim for identity theft discovered following December 14, 2022 must have registered with a credit monitoring system by December 14.

If this condition is not fulfilled, the person complaining cannot be compensated.

“We cannot be reimbursed because it is really part of the eligibility criteria to claim up to $1,000 if you are a victim of identity theft,” explains Chantal Corbeil, senior spokesperson at Desjardins.

This condition has been put in place in particular since claims for identity theft can be made until October 20, 2025.

“In the case of identity theft, you must have suffered since January 1, 2017 to be able to claim. But there are some who might claim because they haven’t suffered a theft yet, but they might in the next few years, so that’s why it’s important to register with Equifax before the December 14, 2022 to be able to make a claim for identity theft if it occurs following that date, ”specifies the spokesperson for Desjardins.

Victims of the data breach who wish to make a claim for the loss of time have until April 20, 2023 to submit their claim.
