The vice president detailed the reasons that lead her to demand that Judge María Eugenia Capuchetti withdraw from the case, and in that sense she alleged “irregularities and arbitrariness from day one.”
The vice president of Argentina, Cristina Fernández de Kirchner, presented this Monday a challenge once morest Judge María Eugenia Capuchetti, who is in charge of the case for the attempted assassination she suffered.
The president detailed in a 37-page document, signed by lawyers José Manuel Ubeira and Marcos Aldazabal, the reasons that lead her to request that Judge Capuchetti withdraw from the case and questions her because, she considers in the document presented, that “He neither knows nor wants to investigate.”
In the text, the complaint maintains that no progress has been made in the lines of investigation that involve sectors of the right-wing opposition, specifically the clue that links the Macrista deputy Gerardo Milman with the attack. And he points out that “it cannot continue like this.”
«We are facing one of the most relevant causes in our democratic history, and we need the investigation to be led by someone willing and for the decisions to be made by an impartial judgecommitted to truth and justice, and not to not bothering those who should not be bothered,” specifies the document that Cristina Fernández shared on her social networks.
«I share the recusal of Judge Capuchetti in the case of the attempt on my life, last September 1. Starting on page seven, the irregularities and arbitrariness of her are detailed from the first day, when Sabag Montiel’s cell phone was deleted,” says the vice president in reference to the loss of information from the phone of the man who tried to shoot her.
«This complaint detected, at the very least, negligent actions on the part of the judge from, literally, the first day of the investigation. “These situations would have been sufficient for the investigation to be sent to another judge,” his lawyers indicated.
The lawyers listed a series of “errors” that made them lose confidence in the judge’s impartiality, among which stand out, in addition to what happened with Sabag Montiel’s cell phone, the delays in the arrest of her alleged accomplices, Brenda Uliarte. (prosecuted as co-author) and Nicolás Carrizo (prosecuted as secondary participant).
Another key point is the handling of the clue involving Deputy Milman, which arose from the voluntary statement of a witness.
According to his story, opposition legislator Milman held a meeting two days before the event with two advisors in a bar located in front of the National Congress in Buenos Aires. «He declared that he heard deputy Gerardo Milman, along with two women who accompanied him, say the following: ‘When they kill her, I’ll be on my way to the coast’«It is stated in the video that the head of the Senate shared last week, when she announced that she would challenge Capuchetti.
Although the information provided by the witness might be verified, Deputy Milman has not yet been summoned to testify, although he denied having stated what the witness stated in interviews with the media.
“Despite all this and this being the most serious act of political violence since the return of democracy, when the first evidence appeared that politics was involved in the attack, Judge Capuchetti paralyzed and boycotted the investigation,” says a voice in ‘off‘in the video shared by Cristina Fernández.
