On April 25, 2023, the Supreme Court overturned the provisional release of former Prime Minister Ibrahima Kassory Fofana. Aly Touré, special prosecutor of the CRIEF, spoke regarding this judgment.
According to Aly Touré, the judgment requested in cassation ordered or confirmed the release ordered by the investigating judges, and he did not agree with this decision: “ The judgment that I requested in cassation ordered or confirmed the release ordered by the investigating judges».
Aly Touré therefore decided to take the case to the Supreme Court, which is the country’s top judge: ” […] I said I don’t agree let’s go to the supreme court which is the top judge in the land. So, we went, the judges of the supreme court overturned the judgment which had ordered the release of Kassory ».
For the special prosecutor of the Court of Repression of Economic and Financial Offenses (CRIEF), this means that the decision to release has never been made, and that Kassory Fofana therefore does not have the right to leave prison.
Kassory Fofana’s lawyers seem perplexed by this decision, but according to Aly Touré, the Supreme Court was clear in its judgment: ” If the Supreme Court had simply dismissed the appeal, it would have meant that the release decision had the force of res judicata and that Kassory Fofana would have been free. But here, the Supreme Court says that the judgment which was referred to it, it cancels it».
We tried to contact Me Sidikié Bérété, one of Kassory’s counsel, by telephone, but he did not answer. However, in the press, he had declared that the special prosecutor’s office of CRIEF had lost to his client.
Aly Touré seems determined to uphold the law and the Supreme Court’s decision, but Kassory Fofana’s lawyers may well continue to fight for his release. The future will edify us.
