Cracked houses: when drought shakes the foundations of the natural disaster compensation scheme

At least 2.5 billion euros! While the drought of summer 2022 will be the most expensive in history for the compensation scheme for natural disasters, known as the CatNat scheme, Christine Lavardespecial rapporteur for the “Ecology, sustainable development and mobility” mission presented findings from its work on funding the Cracked Homes Compensation Scheme by the phenomenon known as shrinkage – swelling of clay soils (RGA) also called “drought risk”.

The human drama of cracked houses by the risk of drought continues to spread across the territory, now exposed to nearly 50%, i.e. more than10 million individual houses.Climate disturbances result in a considerable amplification of the phenomenon. As THE precursor work of the Senate since 2019 have continued to demonstrate this, at the same time,the compensation systemintegrated into the CatNat diet, concentrate dissatisfaction. Too many municipalities (one out of two) that request it are not recognized as being in a state of natural disaster and too many claimant files (one out of two) are rejected by insurance adjusters.

And yet, despite its shortcomings, the financial sustainability of the entire CatNat scheme is jeopardized by the exponential development of claims resulting from the RGA phenomenon.

Provided by the 3DS law, an order, presented on February 8 should provide answers. But far from solving the problemalbeit complex, of compensation, the ordinance proposes to call into question the insurance principle of the scheme by reserving compensation only for the most serious damage those “susceptible”, with all the uncertainties of interpretation that this formulation, which is imprecise to say the least, supposes, “to affect the solidity of the building or to hinder the normal use of the building” . Victims who have nevertheless contributed financially to the scheme will find themselves without compensation because the damage suffered on their home will have been qualified as “aesthetic”.

Moreover, the ordinance has two glaring shortcomings. Firstly it does not in any way address the problem of the financial sustainability of the scheme And on the other hand, it eludes the fundamental issue of prevention.

Because that is where the shoe pinches. Prevention on existing buildings remains the “blind spot” management of the RGA risk. To finally place the essential issue of prevention at the heart of the treatment of the RGA risk and to contribute to the financial sustainability of the CatNat scheme, the rapporteur formulates a series of recommendations to accelerate and amplify the experiments in progress and provide the public funding necessary for the development of prevention measures, in particular by mobilizing the Barnier fund.
