The Third Court of Guarantees of Santiago granted the real precautionary measures requested by the plaintiffs once morest the mayor of Recoleta, Daniel Jadue, in the framework of the Farmacias Populares case.
This request, made by the plaintiff – in this case the company Best Quality SpA – seeks to review the assets of the accused, in order to ensure the existence of sufficient assets to, eventually, determine the reparation or compensation for a crime.
The court, meanwhile, prohibited the accused from entering into contracts regarding his movable or immovable property.
It was determined that the mayor currently has three apartments, two houses and a car, all valued at 549 million pesos, which will be under guard until at least Jadue is convicted; that is, they cannot be transferred or sold.
“The fact that the defendant’s assets, the assets once morest which the precautionary measure is sought, total around 500 million, seems to this judge to be a request that also allows for the concurrence of this budget to be established,” said Judge Katherine Román.
According to the magistrate, “the fraud in relation to the Best Quality company alone amounts to approximately 1,000 million pesos. If we add to this the damage caused to the treasury, which amounts to around 300 million, plus the fines associated with the illegal acts committed once morest the treasury, these should reach an approximate sum of more than 2,000 million pesos.”
Jadue is currently in preventive detention at the Capitán Yáber Penitentiary Annex, since June 3, following being charged as the author of the crimes of disloyal administration, fraud, repeated tax fraud and a bankruptcy crime, related to the extinct Chilean Association of Municipalities with Popular Pharmacies (Achifarp).
The defense is seeking to reverse this precautionary measure as soon as possible, since if he is absent from office for 45 days, according to the Constitutional Organic Law of Municipalities, a new mayor will be appointed.
