The Federal Court of Criminal Appeals upheld the 7-year prison sentence imposed on Nahuel Novelino, arrested for drug trafficking, for sending threatening messages from prison against Mayor Leonel Chiarella and former Ministry of Security official Sergio Maidana. He had already been sentenced to 21 years for crimes related to drug trafficking.
The highest criminal court, made up of judges Gustavo Hornos, Javier Carbajo and Mariano Borinsky, rejected the appeal filed by Novelino’s defense against the conviction handed down by the Second Federal Criminal Court of Rosario for the crime of aggravated coercion.
The events of the case date back to January 2023 and were committed by the defendant while he was detained in the Marcos Paz federal prison. Novelino was charged and sentenced for threatening Maidana and Chiarella through messages sent on WhatsApp.
In his messages, the Venado native demanded that officials not transfer him from one prison to another, given that, up to that date, he had been in several federal prisons (including Salta, Ezeiza and Rawson), as part of his uninterrupted detention since July 2020 for crimes linked to drug trafficking.
“Tell them to stop moving me here and there because there are bullets for everyone, starting with Chiarella.“Novelino said in one of the messages sent to Maidana’s cell phone. A second message arrived just days later: “Oh, son of a bitch? There are bullets for everyone.”
The drug trafficker’s defense requested, among other things, that evidence be dismissed because the ministerial official’s phone was not examined. However, the investigation found that the messages came from one of the 10 phones found on the drug trafficker in the different facilities where he was staying.
Several convictions
Novelino was previously arrested and convicted for leading an illicit association that operated in our city. Since April 2016, he has also been charged with crimes investigated by the provincial courts. While serving his sentence, Novelino coordinated and managed the sale of drugs in Venado Tuerto, bought weapons and ammunition for the gang he led, and even did Snapchat with his girlfriend, Lucía Uberti, convicted of being a “hitman” for the Rosario gang Los Monos.
The sentence of 7 years in prison, imposed after the oral debate and ratified by the Court of Cassation, is added to the 21 years in prison that the same Federal Court of Rosario imposed, after splitting the proceedings of the case, due to the abbreviated trial agreement between the accused and the Public Prosecutor’s Office in relation to the facts related to drug crime and a previous conviction by the provincial court.
