The criminal court of Walloon Brabant on Thursday sentenced a resident of the west of the province, born in 1987, to three years’ imprisonment with a suspended probation period requiring her to undergo regular medico-psychological monitoring. She was prosecuted for rape and incitement to debauchery of a minor. The acts were committed in 2022 and the victim was his 15-year-old stepson. The judgment rendered Thursday also deprives the defendant of her civil and political rights for five years.

At the time of the events, the defendant lived with the teenager’s father and the affair came to light when his girlfriend noticed that the thirty-year-old was sending him suggestive photos on her mobile. The young man admitted that he had had sexual relations with his father’s partner, and that he no longer knew how to handle this situation.

At the hearing, the defendant did not contest the accusations, saying she regretted not having had an adult role by clearly saying no to the teenager. She implied that it was he who had been enterprising. “No, he was not in demand but he did not dare to say no. The question, in any case, does not arise: he was a minor under 16 years old, and might not consent,” retorted the public prosecutor by requesting a sentence of six years in prison.

The judgment rendered Thursday underlines the seriousness of the facts, the young age of the victim, the potential consequences for her and the ease of the defendant’s actions. But to set the sentence at three years in prison with a probationary suspension, the thirty-year-old’s confessions, her personal situation and her regrets were also taken into account.
