In addition, the regional court in Wiener Neustadt issued a ban on activities: since then, the pedagogue has no longer been allowed to work with children and young people.

But as “Puls 24” reports, the now 42-year-old is said not to have followed and in December 2022 held workshops in a home for young people aged 14 and over. The teacher has now been charged with this violation. This district court proceeding carries the risk of a fine or imprisonment of up to six months. The trial is scheduled to take place at the end of May. There is no evidence of abuse by the ex-teacher during his workshop activities for young people, says Markus Bauer from the public prosecutor’s office in Wiener Neustadt in an interview with OÖN. Only the prohibited practice of the profession was brought to the indictment.

The youth facility that hired the ex-teacher for the workshops therefore knew nothing regarding the conviction from 2017. Because it was already considered to be erased in the criminal record. However, according to “Puls 24”, the facility has refrained from obtaining a so-called extended criminal record certificate in the sense of child and youth welfare. Accordingly, no additional check was carried out. However, employees were always present in the room during the man’s lectures, it said.

The allegations that led to the educator’s conviction at the time weigh heavily: he was also found guilty of serious abuse and abuse of his position of authority because of pornographic depictions of minors. Five years ago, the regional court in Wiener Neustadt sentenced the teacher to two years of unconditional imprisonment.

The pronounced ban on activities is a consequence of the verdict, says prosecutor Bauer: comparable to the confiscation of the murder weapon in a violent crime. The perpetrator loses the right to carry out certain professions and activities. According to the law, however, this does not apply to life.

Court reviews every five years

Every five years, the court must check whether the perpetrator still poses a danger to children and young people. “In any case, the ban on activities was still in effect in December 2022,” says the spokesman for the prosecution.
