Controversy Surrounding Talya’s Tragic Death: Mother’s Conditions to Avoid Euthanasia of Iron

Talya’s mother gives this Sunday her conditions to avoid euthanasia to Iron. As a reminder, the 8-year-old girl died on July 12, 2021 when she was left alone at home with two American Staff breed dogs. One of the animals had bitten Talya, who died of her injuries. Iron, the second dog, was taken in following the fact by the Animal Protection Society (SPA) of La Louvière.

Here are the explanations of the mother, relayed by her lawyer, master David Gelay:

My client has never disputed her responsibility for the tragedy and lives every day with an indescribable feeling of sadness and guilt for having left her alone with her dogs when she had gone to a neighbor’s house for a few moments to ask for his help. .

It should be remembered that when she arrived at the scene of the tragedy, she found that her two American Staffordshire terriers had bloody chests and mouths. The first will be immediately killed by the police while the second, Iron, who had fled, will later be caught with the little girl’s long black hair between her teeth. In this regard, the Mons Court of Appeal adds to the prison sentence pronounced once morest my client the obligation, if the dog is returned to her, to have it euthanized, specifying that “it is an appropriate condition given the dangerousness of the dog concerned who attacked and killed an eight-year-old girl whom he knew well and whose mistress had not detected any particular aggression towards her until then”.

To that extent, my client, in memory of Talya, objected and still morally objects to Iron being put up for adoption and having any contact with a child. On the other hand, she harbors no feeling of revenge towards the animal assuming the responsibility for the drama. Its only objective is to prevent another tragedy from occurring. To this extent, my client would be willing to waive the euthanasia of the dog entrusted to the SPA provided that the latter makes the formal and non-negotiable commitment, formalized in an agreement that Iron will remain, until the end of his life, under his entire responsibility, will never be put up for adoption and will never be in contact with a child.

With this in mind, we had long exchanges with Mr. Jacques GOBERT, mayor of La Louvière who accepted this principle and explained to us that “his decision to return the dog to its owner was motivated by the desire not to take the risk that he be put up for adoption because the veterinarians consulted (including the one mandated by the SPA) recommend adoption in a family where he will be the only dog and a family without children under 12 with regular monitoring, proof that the risk of accident is always very present.Even if these conditions were met, no guarantee can be given that a future transfer of the dog would circumvent these impositions. However if the SPA via agreement makes the commitment never to transfer, to put up for adoption by any formula whatsoever, nor to put the dog in contact with minors, I might agree to entrust him to the SPA for the rest of his life and this under his full responsibility”.

A proposal will therefore be made to this effect this Monday at the SPA to see if an agreement can be reached between the parties which should make it possible to avoid the occurrence of a new tragedy and thus guarantee public safety. My client for her part specifies that she will never recover from the loss of her child whom she loved and wishes today to continue the work of necessary mourning.

The SPA opposes euthanasia

Recall that the Hainaut Court of Appeal sentenced little Talya’s mother on Tuesday to a 12-month prison sentence with a five-year suspended probation for manslaughter. The condemned is now prohibited from owning dogs, regardless of race. As for the dog confiscated by the first judgment, the justice indicated that it will be euthanized in the event that it is recovered by the condemned.

According to the SPA, the La Louvière police showed up at the shelter on Friday. The objective was to “enforce an order from the mayor to return the Amstaff to its owner, Talya’s mother, and to euthanize it“. The SPA of La Louvière has decided to lodge an appeal in extreme urgency before the Council of State in suspension of a decree of the local mayor, said Friday Gaëtan Sgualdino, spokesperson for this animal protection society.

It remains to be seen whether the proposal that will be made this Monday by the mother will make it possible to find an agreement with the SPA.
