Between 2017 and 2019, his three posthumous albums broke sales records. This allowed his record company, according to Le Canard enchaîné, to pocket 333,890 euros via the private copying levy. A system, funded by storage device companies, intended to compensate for the loss of income due to copying: “Private copying remuneration allows, for example, to copy our favorite film on our box, to record our music or our favorite images on our smartphone, to read our books on our tablet. In return, the manufacturers (or importers) of these storage media pay a remuneration for the authors, artists, publishers and producers of the works which are thus duplicated”, explains the association La Culture with La Copie Privée.

Since it is completely legal, why does this remuneration make the Court of Auditors wink and trigger controversy in France? Quite simply because this measure was created with the aim of remunerating injured authors and producers (75%) and for creation assistance (25% of the sums collected) in order to promote diversity and the emergence of new talents. . Many voices are therefore raised to say that the spirit of this royalty has been diverted when such large sums are paid for a deceased artist.

Johnny Hallyday is not the only one targeted by criticism. According to the Court of Auditors, in 2021, Florent Pagny received 271,000 euros via this fee, Bernard Lavilliers 120,000 euros Benjamin Biolay 119,000 euros and Juliette Armanet 154,000 euros. However, they are all confirmed artists. This leads the Court of Auditors to ask questions regarding “the usefulness of significant aid granted to projects carried out by established artists and whose economic balance does not appear to require any particular support”.

A controversy which would have gone well Laeticia Hallyday, who is trying to repay the tax debts of her late husband, estimated at 30 million euros.
