Controversy and Suspension: Mons-Quévy Police Chief Faces New Legal Battle

A little drama, this Wednesday evening, in the case of the head of the Mons-Quévy police zone. The police college, made up of the mayors of Mons and Quévy, has just initiated a suspension procedure once morest him. A decision which follows the mayors becoming aware of new elements following the car accident of which Jean-Hubert Nicolay was the victim in March 2022.

As a reminder, at the time, the Mayors had entrusted the disciplinary file linked to this accident to the Federal Minister of the Interior, in accordance with the law which provides for this scenario for a commander. Since then and as we explained once more in our columns in November 2022, the disciplinary aspect is still ongoing at the level of the Minister’s services.

“In the meantime, the Chief of Staff informed the President of the Police Zone that he was summoned to appear on several charges before the Mons Criminal Court,” explain Nicolas Martin (PS) and Florence Lecompte (PS ). Consequently and having knowledge of the initiation of criminal proceedings once morest the Chief of Staff, Mayor Nicolas Martin brought together the Zonal College, in the absence of the person concerned, in order to analyze this new information.

”In accordance with the Law, the Police College has decided to initiate a suspension procedure by order measure (four months, renewable) with regard to its Chief of Staff, Jean-Hubert Nicolay. He will be heard to present his defense in the coming days by the Mayors meeting at the Police College, in order to rule immediately.”

And to specify: “This decision follows the logic that the College adopted from the start of the case, namely to act in compliance with the various procedures, with order and method.” As a reminder, Jean-Hubert Nicolay was the victim of an accident in March 2022, during the night. While he was at the wheel of his company vehicle on the R5, the commander of the Mons-Quévy police zone lost control of his vehicle and rolled over a few hundred meters from his home. Slightly injured, he was taken to hospital for a few stitches.

Quickly following the incident, the press revealed that according to the blood test taken at the hospital, the officer’s alcohol level was 3.06 grams per liter of blood, or six times more than the authorized driving limit… While the result of the breathalyzer carried out by the teams from the Boraine police zone on the evening of the accident was negative. At the political level, reactions were quick. Mons en Mieux had thus demanded the immediate suspension of Jean-Hubert Nicolay and that full transparency be made in this matter.
