Controversial Night Shop Manager Receives 7-Year Sentence for Death of Afghan Boy: Case Details and Outcome

Omar K., the manager of the night shop who took the life of a 19-year-old Afghan boy in April 2021, finally received a 7-year prison sentence last Tuesday by the Nivelles Assize Court. The facts were reclassified as assault and battery resulting in death without intention to cause it. He is immediately eligible for parole since he has already served a third of his sentence.

The facts date back to April 24 around 4 p.m. at Chaussée de Haecht in Schaerbeek. “Two groups of Afghan youth had a disagreement on TikTok. They threatened each other by brandishing guns and knives. They were trying to show that the Antwerp group was stronger than the Charleroi group. That day, the Antwerp group of 17 people came to Brussels to the night shop of a guy who is the brother of our client and who has a store in Brussels. Our client was then called by his employee to indicate that there was trouble,” explain Me Jonathan De Taye and Yannick De Vlaemynck, who replaced Sébastien Courtoy in this case.

Once there, Omar K. talks with the young people to try to calm them down before being punched in the face while he is on the doorstep. “Following this, he grabbed a 17 cm knife, chased one of the young people in the street, not the one who hit him, and stabbed him in the back. The lungs and heart were affected. He died in hospital. During the trial, the young Afghans claimed that they had come to Brussels to play cricket but this version was not credible. The prosecution had requested murder and we pleaded the absence of homicide intent,” continues Mr. De Vlaemynck.

The Nivelles Assize Court finally ruled in favor of Omar K’s defense. “Our client spent his entire preventive detention under the modality of the electronic bracelet and he is immediately eligible for conditional release because he has already served a third of his pain. In the end, he will have served four months in prison, and then two years and two months under an electronic bracelet, so he will have served very little time in prison,” he adds.

A judgment experienced as a victory by the defense of Omar K. The main person concerned is satisfied with his fate. “For him, everything is destiny. If he had taken 20 years, he would have accepted it. He just wanted to be judged and convicted for ‘making a mother cry’. He experienced so much drama during his adolescence in Afghanistan. He arrived in Belgium without reference and takes life as it comes,” he concludes.
