An Australian teacher who confessed to having sex with a 16-year-old student avoided jail time before being released on Tuesday, according to 9 News reports.

Monique Oom was seen crying outside the Melbourne Court of Appeal following hearing her 300 hour community service sentence. She had pleaded guilty to four counts of a sexual nature once morest a minor in her custody or under her supervision.

The Victoria Public Prosecutions Office appealed the original decision in March. He said the 31-year-old deserved a heavy prison sentence for abusing her position of authority at Sale Secondaire College.

Judges Richard Niall, Maree Kennedy and Cameron Macaulay, however, dismissed the appeal and said Monique Oom’s mental illness would make a custodial sentence “catastrophic” for her.

The defense had argued in court that the teacher was depressed due to her alleged infertility when she had sex with the boy. However, in July, at the time of her conviction, she was pregnant.

After contacting the victim for the first time, Monique Oom started sending him photos of herself in her underwear. The first sexual encounter between the two occurred in May 2022. They had multiple sexual encounters at her home and in her vehicle, before the school administration was informed of the situation by an anonymous letter.
