Constitutional Court Decision Number 60 Makes Political Parties Confident in Nominating Their Own Cadres

UNTIL the second day of registration of prospective regional head candidates for the 2024 Pilkada, Wednesday (28/9), there was a surprise related to the change in political constellation as reflected in the change in party support for previously nominated candidates. Executive Director of Algoritma Research and Consulting, Aditya Perdana, this is inseparable from the accommodation of Constitutional Court Decision Number 60/2024.

“This surprise has caused some political parties who feel capable of nominating their own cadres to want to appear alone, it can be seen that PDI Perjuangan, PKS, or PKB are doing this,” Aditya told Media Indonesia, Thursday (29/8).

This surprise, he continued, indicated that a number of political parties were confident and felt capable of putting forward their own cadres in the 2024 Pilkada contest, without needing to join or form a coalition with other parties.

One example can be seen from how the Golkar Party’s attitude towards its own cadre, namely Airin Rachmi Diany, changed in the 2024 Banten Pilkada. Previously, together with the Advanced Indonesia Coalition (KIM), Golkar expressed its support for Gerindra cadre, Andra Soni, as a candidate for governor of Banten.

However, after PDI Perjuangan declared Airin, Golkar actually turned around. Under the leadership of Bahlil Lahadalia, Golkar on Tuesday (27/8) gave its support to Airin. Thus, Aditya said the KIM scenario of producing a single candidate failed.

“This surprise from Banten shows that efforts to push for a single candidate were unsuccessful due to the Constitutional Court’s decision,” he explained.

In DKI Jakarta, although the KIM’s strength is still solid, Aditya highlighted the PDI Perjuangan’s move to nominate Pramono Anung as a gubernatorial candidate, instead of Anies Baswedan or Ahok. For him, the PDI Perjuangan’s move is interesting because Pramono is a figure who is in the middle ground between groups within the party.

“This means that the choice taken by PDIP in Jakarta is also realized as not having the best chance of winning the regional election, but it is important for the organization of the party in the future,” he emphasized.

It is known that the Constitutional Court Decision Number 60/2024 revised the nomination threshold for parties or coalitions of parties by 20% of the number of seats or 25% of the accumulation of valid votes in the DPRD which was previously stated in the Regional Election Law.

Through this ruling, the Constitutional Court lowered the nomination threshold for parties or party coalitions and aligned it with the requirement for support for individual or independent candidates according to the population on the permanent voter list in each region.

The Constitutional Court also removed the rule that only allowed parties with seats in regional parliaments to propose regional head candidate pairs. Thus, parties that have participated in the 2024 Election, but do not have representatives in the DPRD, can still nominate prospective regional head candidate pairs with valid votes.

Until the second day of registration, the provincial KPU throughout Indonesia has received 21 candidate pairs supported by political parties. Meanwhile, at the district level, the KPU received 12 independent candidates and 200 party candidates. Meanwhile, at the city KPU level, there are 3 individual candidates who have registered, while there are 33 pairs from the party route. (Tri/P-2)
