The Science, Innovation and Technology Commission of the Congress of the Republic unanimously approved an opinion that will allow for a new Teleworking Law.
The proposal will apply to public and private workers, who will also have the same rights with respect to those who work in an office in person.
If the rule is approved in plenary session of Congress and then promulgated by the Executive Power, Law No. 30036, currently in force, and which regulates remote work, would be repealed.
The president of the commission, Flavio Cruz (Free Peru), explained that the opinion brings together in a substitute text the bills presented by him and by Adriana Tudela (Avanza País).
“It is going to generate a great labor change in the country because the use of technologies will be incorporated so that a worker can carry out their work from home or somewhere else, but not in an office,” said.
What does the standard state?
- The voluntariness and reversibility of teleworking is maintained.
- It is regulated that the effective working hours achieve the expected results.
- The right to digital disconnection is incorporated and places limits between work and family life.
- The compensation of expenses incurred by the teleworker for the labor service and the use of overtime, among other scopes, is regulated.
Likewise, at the request of Congresswoman Tudela, it was approved by a majority to include in the opinion a provision that allows an employer and a teleworking server to sign an agreement that guarantees the right to receive equipment, Internet access or compensation for electricity consumption.
The proposed law has 28 articles, nine final complementary provisions and one repealing complementary provision.
