COMMUNIQUE OF THE COUNCIL OF MINISTERS OF FRIDAY MARCH 31, 2023

The Council of Ministers met today, Friday March 31, 2023, in the usual room for deliberations, under the chairmanship of His Excellency, Mr. MOHAMED BAZOUM, President of the Republic, President of the Council of Ministers.

After reviewing the items on its agenda, the Board took the following decisions:

I. IN THE TITLE OF THE MINISTRY OF FOREIGN AFFAIRS AND COOPERATION.

The Council of Ministers examined and adopted the draft texts below:

1.1. Draft Ordinance authorizing the ratification of Loan Agreement No. 2100150043444, for a maximum amount equivalent to twenty-five million units of account (UA 25,000,000), i.e. approximately twenty billion five hundred twenty million four hundred seventy-five thousand (20,520,475,000) CFA francs signed on February 06, 2023 in Niamey, between the Republic of Niger and the African Development Fund (ADF), for the partial financing of Project 2 of the Resilience Building Program in Food and Nutritional Insecurity in the Sahel (P2-P2RS).

The overall objective of the project is to contribute to the improvement of food and nutritional security and the living conditions of the populations of the Sahel.

The project financed by the loan agreement, subject of this draft order, will be implemented through the four (4) components below:

•strengthening the resilience to climate change of agro-sylvo-pastoral and fisheries production;

•the development of agro-sylvo-pastoral and halieutic value chains;

•the strengthening of adaptive capacities;

•the coordination and management of the Programme.

1.2. Draft order authorizing the ratification of Loan Agreement No. 2022012/PR NG 2023 05 00, for an amount of twenty-one billion seven hundred and thirty-five million (21,735,000,000) CFA francs, signed on January 31, 2023 in Niamey, between the Republic of Niger and the West African Development Bank (BOAD), for the partial financing of the Hamdara-Wacha-Dungass-Nigeria Border Road Development and Asphalting Project.

The overall objective of the project is to ensure the opening up of the area in order to facilitate economic, social and cultural exchanges at national and sub-regional level.

The project financed by the loan agreement, subject of this draft order, will be implemented through the following three (3) components:

•the studies ;

•works and inspection;

•institutional support and project management.

These two (02) draft ordinances are taken in accordance with Law No. 2022-70 of December 26, 2022, empowering the Government to issue ordinances during the parliamentary intersession and this, following consulting the Constitutional Court.

II. IN THE TITLE OF THE MINISTRY OF JUSTICE.

The Council of Ministers examined and adopted the Draft decree amending and supplementing decree n° 2020-295/PRN/MJ of April 17, 2020, on the terms of application of law n° 2018-35 of May 24, 2018, on status of notaries.

The purpose of this draft decree is to correct and make applicable the provisions of Articles 31 and 32 of Decree No. 2020-295/PRN/MJ of April 17, 2020, with regard to the conditions of access to the internship for aspirants. -notaries.

III. IN THE TITLE OF THE MINISTRY OF URBAN PLANNING AND HOUSING.

The Council of Ministers examined and adopted the draft texts below:

3.1. Draft decree establishing a public establishment of an administrative nature known as the “National Geographic Institute of Niger”, abbreviated (IGNN)

3.2. Draft decree approving the statutes of the National Geographic Institute of Niger (IGNN)

The purpose of the two draft decrees is to bring the texts establishing, organizing and operating the IGNN into compliance with the provisions of Law No. 2020-020bis of June 03, 2020, setting the rules for the creation of categories of public establishments and its implementing decree.

IV. PERSONAL MEASUREMENTS.

The Council of Ministers has adopted the following individual measures:

4.1. IN THE TITLE OF THE PRESIDENCY OF THE REPUBLIC

•General of the Army Corps Lawel Chékou Koré, is appointed Inspector General of the Armed Forces and the National Gendarmerie.

4.2. IN THE TITLE OF THE MINISTRY OF NATIONAL DEFENSE

•Major General Abdou Sidikou Issa is appointed Chief of Defense Staff.

•Brigadier General Ibrahim Bagadoma Mahamadou, is appointed High Commander of the National Gendarmerie.

4.3. IN THE TITLE OF THE MINISTRY OF EQUIPMENT

• Mr. Ibrahim Allassane, public works engineer, Mle 64048/G, has been appointed technical adviser to the Minister of Equipment.

•Mr. Yayé Bilan, public works engineer Mle 55727/Y, has been appointed director general of rural roads.

•Mister Maman Lawali Issaka Harou, jurist, Mle 136295/Y, is appointed Director of Legislation.

4.4. IN THE TITLE OF THE MINISTRY OF PLANNING

• Mrs. Ousseini Falalou Fatimata, administrative director, Mle 85378/V, has been appointed director of economic analysis, forecasting and modelling.

• Mr. Ousmane Issoufou Abdou, Head of General Administration Division, Mle 116475/T, has been appointed Director of Economic Reforms and Structural Transformation.

•Mr. Chétima Tar, principal treasury inspector, Mle 110995/S, has been appointed director of financial resources, equipment, public contracts and public service delegations.

•Mr. Anaroua Manou, Statistical Economist Engineer, Mle 162053/W, is appointed Director of Statistics and IT.

• Mr. Seyni Soumana, statistical work engineer, Mle 62434/A, has been appointed director of studies and programming.

•Mr. Galadima Chittou Ali, Administrative Director, Mle 87208/T, has been appointed Director of Performance Monitoring and Evaluation of Development Projects and Programs.

• Mrs. Amadou Gado Hadiza, Administrative Director, Mle 111601/N, has been appointed Director of Human Resources.

4.5. IN THE TITLE OF THE MINISTRY OF REGIONAL PLANNING AND COMMUNITY DEVELOPMENT

•Mr. Harou Abdou Salam, Administrative Director, Mle 87060/N, has been appointed Director General of Regional, Local and Community Development.

•Mr. Hassane Hamidine, agricultural engineer, has been appointed Director General of the Nigerien Agency for Volunteering for Development.

4.6. IN THE TITLE OF THE MINISTRY OF THE INTERIOR AND DECENTRALIZATION

•Mr. Abdou Boubacar, Mle 116400/X, has been appointed director of financial resources.

4.7. IN THE TITLE OF THE MINISTRY OF AGRICULTURE

• Mr. Samba Ly Souleymane, agricultural engineer, is appointed chairman of the board of directors of ONAHA.

V. COMMUNICATIONS.

The Council of Ministers heard several communications:

• a communication from the Prime Minister relating to the award of two (02) public contracts made up of two (02) lots:

•lot no. 1: Construction work for two (02) 500 M3 stainless steel water towers on a 20m metal tower.

•Lot no. 2: Construction works for the PVC DN 315 PN 16 pipe network of 1858 lm and station equipment.

•a communication from the Minister of Agriculture relating to the awarding of public contracts through open international calls for tenders for the construction works of the Semi-Wholesale markets for agricultural products and the construction of 51 km of rural roads in the region of Tahoua.

Construction of two (2) Demi Gros markets

• Lot No. 1: Construction works for the semi-wholesale market for agricultural products in Guidan Idder.

•Lot 2: Construction works for the semi-wholesale market for agricultural products in Tounfafi.

Construction of 51 km of rural tracks

• Lot No. 1: Construction works of the rural track of Guidan Idder-Tajaé-Junction of the Malbaza-Dabnou road, 17.264 km long, in the rural communes of Malbaza and Tsernaoua.

• Lot n° 2: Construction works of the Guidan Idder-Faska rural track 7.850 km long, the Kiara ramp 0.872 km long, the Kanassori ramp 1.152 km long and the Ambaroura ramp long of 2.123 km.

•Lot 3: Construction/rehabilitation works of the Guidan Idder-Tallé rural track, 10,000 km long and the Madetta ramp, 2,269 km long.

•a communication from the Minister of Public Health, Population and Social Affairs relating to a public contract for the acquisition and installation of three (3) oxygen plants at the level of the Regional Public Health Directorates of Tahoua, Zinder and Maradi including user training.

•a communication from the Minister of Post and New Information Technologies relating to the awarding of a public contract for works to implement the optical infrastructures of the Trans-Saharan Fiber Optic Dorsal (DTS) in Niger, relating to the civil engineering works, energy equipment and transmission and monitoring equipment.

These four (4) communications are made for information purposes, in accordance with the provisions of Order No. 018/PM/ARCOP of January 18, 2023, setting the thresholds in the context of public procurement which provides in its article 13 that: “Any public purchase whose amount is equal to or greater than three hundred million (300,000,000) CFA francs excluding value added tax must be the subject of a prior communication to the Council of Ministers on the part of the Minister in charge of the sector concerned”.

•a joint communication from the Ministers of Planning and Finance on the estimate of Niger’s economic growth in 2022.

Niger’s real economic growth stood at 11.5% in 2022. This performance is due to the good performance of the agriculture branch in 2022 and the impact of the economic policy measures implemented by the government. In value, the Gross Domestic Product (GDP) increased from 8,270.8 billion CFA francs in 2021 to 9,569.9 billion in 2022, i.e. a nominal growth rate of 15.7%.
